NO. 1089 AN ACT entitled an act to repeal chapter 322 of the General Laws of Minnesota for the year 1905 relating to assistant county attorneys in certain counties. Be it enacted by the Legislature of the State of Minnesota: Section 1. That chapter 322 of the General Laws of Minnesota for the year 1905 be and the same is hereby repealed. Approved April 21, 1909. CHAPTER 327-H. F. NO. 1118. AN ACT entitled an act to authorize all cities in this state now or hereafter having a population of over fifty thousand inhabitants. to condemn lands for harbors wharves, boat landings and such canals and approaches thereto as may be required therefor. and to levy taxes therefor. Be it enacted by the Legislature of the State of Minnesota: Section 1. That hereafter any city in this state now or hereafter having population of over fifty thousand inhabitants, shall have the right, power and authority to condemn lands under the right of eminent domain. for harbors, wharves boat landings and such canals and approaches thereto as may be required and shall have the right, power and authority to levy taxes for the purpose of raising moneys required for the payment of damages and other expenses arising in or out of such condemnation proceedings such power and authority to condemn land shall be exercised under and pursuant to the terms and provisions of chapter 41, of the Revised Laws of 1905 and acts amendatory thereof: Provided however that any such city shall have the right, upon the filing the award of the commissioners provided for in said chapter 41, and upon giving the notice therein required of the filing of such award. to enter upon and appropriate the land SO condemned, without JO CRSE up and puoq any JO STATE the such entry and appropriation, such city shall be bound absolutely to pay all damages awarded either by said commissioners or by the court upon appeal therefrom. together with all costs and expenses adjudged against it therein, with in the time specified in said chapter 41 In case any such city shall appeal from the award of the commissioners appointed pursuant to such condemnation proceedings. such city shall not be required to give or file any appeal bond therein. This act shall apply to cities now having a home rule charter adopted under and pursuant to section 36, of article four of the Constitution of the State of Minnesota. Sec. 2. AN ACT to authorize the state treasurer and state auditor to charge off and cancel accounts carried in the state treasury in certain suspended banks. Whereas, it appears by the books and records of the state auditor and state treasurer that certain sums are now car. ried on the records, purporting to be cash in the treasury in the following defunct or suspended banks. to-wit: $88433 State Bank of Minneapolis Farmers' and Mechanics' State Bank, Minneapolis 6,972.84 American Exchange Bank, Minneapolis 6,257.66 Purchased assets of the American Exchange Bank 2,160.03 $16,274.88 JO total V Whereas, said accounts do not represent cash in the treasury as they purport to do, but in fact represent the remainder of assets acquired by the state. pursuant to the provisions of chapter 250. Any such society may continue to do business in this state until the first day of March, A.
