SHERIFF'S SALE OF UNDIVIDED INTEREST IN A VALUABLE FARM Located In Election District No. 5 of Garrett County, Maryland Under and by virtue of two writs of fieri facias issued out of the Circuit Court for Garrett County, the first at the suit of George W. Page, Receiver, use of First State Bank of Grantsville, E. S. Duckworth and Charles and Mrs. Peter Reichenbecher, vs. William and Orpha Failinger, the same being No. 47 Trials, December Term, 1931, and the second at the suit of George W. Page, Receiver, use of First State Bank of Grantsville, E. S. Duckworth and A. G. Reichenbecher vs. William and Orpha Failinger, the same being No. 53 Trials, December Term, 1931, said writs being in Nos. 3 and 4 Judicials, September Term, 1937, of said Court, and to me directed, I the undersigned Sheriff of Garrett County have seized, levied upon and taken under execution by actual entry upon the property, all the right, title and interest of the said William Failinger and Orpha Failinger, his wife, in and to the hereinafter mentioned property, and I hereby give notice that on SATURDAY, JULY 17, 1937, at the Hour of Eleven o'Clock A. M., in front of the Court House, in the town of Oakland, Garrett County, Maryland, I will offer for sale and sell at public auction all of said interest in the following real estate, situate in Election District No. 5 of Garett County, Maryland, to-wit: 1st. All those two parcels of land containing in all 221 acres and being the same which were conveyed to John Failinger by deed from S. H. Rylands and Ella Rylands, his wife, dated April 7, 1892, and recorded in Liber E. Z. T., No. 19, Folio 406, one of the Land Records of Garrett County, Maryland, to the record of which said deed reference is hereby made for a full and complete description of said land by metes and bounds, courses and distances. Saving and excepting the quantity of 35 acres heretofore conveyed by John Failinger and Matilda Failinger, his wife, to Theodore H. Spear and others, dated January 3, 1895, and recorded in Liber E. Z. T., No. 38, Folio 83, one of said Land Records of Garrett County, to the record of which said deed reference is also hereby made. 2nd. All that part of Military Lot No. 2198, containing five acres, being the same which was conveyed to the said John Failinger by deed from Louis Neil, dated September 21, 1901, and duly recorded in Liber E. Z. T., No. 40, Folio 126, one of said Land Records of Garrett County, to which said record reference is hereby made for a complete description of said parcel of land. The above parcels of land compose what is known as the John Failinger farm situate along the National Highway between Keyser's Ridge and the Pennsylvania state line, containing 191 acres, more or less. A large part thereof is cleared and under cultivation and it is improved by an excellent dwelling, barn and other outbuildings. The interest in this farm which has been levied upon and will be sold is the undivided one-half interest or estate in remainder, subject to a life estate of Matilda Failinger, which was devised to the said William Failinger by the last will and testament of John Failinger, deceased, dated December 19, 1924, duly probated in the Orphans' Court for Garrett County, and recorded in Wills Liber C, Folio 394, one of the records in the office of the Register of Wills for said Garrett County.
