ANSWER IS FILED IN DEPOSIT CASE Wabash, Ind., Feb. 11.-An answer was filed today in the suit of Harley E. Fawcett against the Indiana Lawrence/Bank and Trust Co., of North Manchester, in which Fawcett is seeking to collect money he has in the bank on a certificate of deposit. In the answer it is set out that prior to February 2, last year, Faw. cett had approximately $3,000 on deposit in the bank. Owing to threatened run on the bank at that time the institution closed for a few days in order to have depositors sign "protective agreements" by which they promised not to demand full payment on funds they had in the bank and thus permit the bank to continue operation. Fawcett signed such an agreement, but is now demanding his money. The bank sets out that it has of fered to advance him $700 on his deposit, but that to pay him the full amount he had on deposit and not pay others would be unjust. -
