Bank Cases Up In Court Here Default Judgments For Pair Of National Banks Given On Instructions Of Judge In Federal Hearing Default judgments for two national banks and for Kent county, amounting to approximately $145,000 were awarded by juries in federal district court Monday afternoon on instructions from Judge James C. Wilson. There were 12 cases brought by the First National bank of Jayton, two by the Floyd County National bank and three defendants out of group of 12 or 15 in R. case brought by the county. Trial of equity issues in the case brought by Kent county against M. S. Sandell, former president, and others was begun yesterday afternoon, following the awarding of judgments amounting to approximately $102,000 against T. Houston Ward, Mrs. Margie E. Ward and W. M. Ward. W. T. Cathey, county clerk of Kent county and L. B. Withers, receiver of the closed bank, were the witnesses. Motion Overruled Motion by the Farmers and Merchants National bank of Abilene, named as a defendant, to dismiss, filed 85 a general demurrer, was overruled following arguments by Robert Bean. William H. Evans and George S: Berry. attorneys for the county and T. McMahon, attorney for the bank. H. G. Andrews attorney for Mr. Withers, made argument for his client. Witnesses in the case included: Henry James, president, and Fleming James, assistant cashier of the Farmers and Merchants National bank of Abilene; A. M. Turner, former vice-president of the Jayton bank and Ellis Scoggins, former assistant cashier of the bank. The county witnesses include: Ab Cargile, C. H. Cade, Bert Wallace, W. T. Cathey and Mrs. A. B. Ward. Sale Authorized Judge Wilson authorized the Floyd County National bank receiver to sell a second hand automobile, property of the bank at the time it went into receivership and also authorized the receiver to sign an casement for approximately six acres to the state highway department, on land it received in a judgment. The property was received from the Muncy family in settlement of a bank claim. Default judgments secured by the Jayton bank. through H. G. Andrews, attorney. included: M. S. Sandell, $8,625.33; Thomas W. Fowler, $2,701.65; W. L. Mathews, $1,080.66; T. E. Murdock $3,241.98; T. Houston Ward, $8,645.33; Ara B. Foley and Mrs. W. A. Foley $1,080.66 Toney Lindhorst, $1,620.99 and foreclosure of lien on hand; John W. Hall and Elmer Hall, $219.48; W. M. McLaury. $1,603.12; W. J. Lane as administrator of the estate of the late W. E. Green, $5,403.30; W. M. Hunter, $2,161.32; R. L. Alexander, $1,080.66. The Judgment against Hall and McLaury were on notes and the remainder on stock assessments. Bank Gets Judgment The Floyd County National bank was given judgment against L. B. Surginer for $5,119.72 and against Raymond Allen for $622.77. general demurrer by Dr. E. O. Nichols and the Plainview sanitarlum and Dr. J. Harvey Hanson was sustained by Judge Wilson in the suit by O. K. Sykes against the two, following arguments at the morning session. The plaintiff was given leave to amend his petition and It is probable the action may come up today. Franklin D. Brown of Lockhart and Brown represented Dr. Hanson, and George Dupree of Bledsoe, Crenshaw and Dupree the Sanitarfum. M. J. Baird of Plainview and W. W. Campbell of Vickers and Campbell represented the complainant. Mr. Sykes had asked for $15,000 damages, following treatment at the sanitarium.
