Smith-Locke Note Case Goes to Trial Bank Superintendent Asks Judgment on Note Involved in Bank Suspension The trial of an action to determine the legality of claim by Fred R. Smith, superintendent of banks, acting in behalf of the Sherman State bank which closed in 1925, is being in circuit court today before Judge L. L. Fleeger. The action was filed against L. B. Locke of This litigation involves a $2,000 note which is alleged to have been held by the bank against Mr. Locke at the time when the bank closed. Credit for deposit in the bank at the time has been given on the note and the bank superintendent now seeks to recover the balance, which is approximately $900, said. However, the defense contends that on the day before the bank closed Mr. Locke paid $1,035 on note, and that this have been applied the $2,000 obligation. The plaintiff claims that Mr Locke on that day paid $1,035 note which was and returned to him. Verne H. is attorney for Mr. Smith in this case, while Krause & Krause represent the defendant. The action is being tried to jury. Mrs. M. C.
