# ANOTHER INTEREST SUIT Over the Illegally Deposited State Funds. Will be Heard Today Before Circuit Judge Boise. The case of Theodore Nolf versus the Williams & England Banking Co., is for the purpose of obtaining an order of the court requiring the repayment of interest paid on state moneys deposited in the bank. These claims were formerly allowed by Judge Boise, but a recent decision based upon the objections of Ladd & Bush, finds that the deposits were state funds unlawfully depcsited on which interest was asked. These ciaims are as follows: E. C. Giltner, agent $25,000 00 Phil Metschan, state treasurer 8,613 60 Phil Metschan 789 73 W. H. Odell 5,047 27 E. J. Swafford 7,349 33 The last sum was deposited by Mr. Swafford while city treasurer. The claim of Odell was fully justified by Judge Boise in his decision. Nolf the petitioner in this case, was a depositor in the sum of $600. As the state funds were unlawfully deposited, he represents that in justice to all other creditors, the receiver, W. T. Slater, be enjoined from making further payments until the court so orders. That Metechan be required to reinburse the receiver on account of all moneys wrongfully diverted from the general fund and obtained by him and that the receiver retain any money found lawfully due to Metschan or Giltner so as to reimburse the fund in his hand on account of all money so wrongfully retained by him. He also asks that the receiver be required to bring action against all obtaining money unlawfully, as said Metschan & Giltner. All funds so received to be divided pro rata among the several claimants lawfully entitled to receive same. John H. and C. L. McNary are attorneys for Nolf, L. R Webster and Carson & Adams for Giltner; L. H. McMahan for Odell; Carson & Adams for Swafford, Baker and the same with Webster for Metschan. Notice of appeal to the supreme court from the recent decision of Judge Boise has been filed, in the case of J. A. Baker v. the Williams & England Banking Co. The decision was based on the petition of Ladd & Bush, creditors of the bank, that no interest be paid upon the claims of Phil Metschan, E C. Giltner, W. H. Odell E. J. Swafford and the petition was granted by Judge Boise.
