DIRECTORS NOT SATISFIED WITH RECEIVER'S WORK Notice of appeal from the des Sion of Judge Langan appointing a receiver for the State Bank & Trust Company was filed in Carson Monday by certain of the directors of the defunct institution. Judge Langan's jurisdiction in appointing a receiver is questioned, the directors claiming that this is a part of the State Bank Commissioner's duty. The fact that Judge Langan made the appointment at the request of the Attorney General bears no weight, according to the appeal. Wils Brougher, one of the directors, failed to sign his name to the notice. His attorney, Samuel Platt, made the following statement: "I was requested by the attorneys for the other directors to join with them in this appeal, but after due deliberation declined to do so. I appeared in court on return day to show cause, as Brougher's attorney and a representative of the State Bank and Trust Company, and to assist the court in any way possible in arriving at a conclusion. "At the conclusion of the hearing I gave it as my opinion that the showing, both upon the facts and upon the law, was insufficient to warrant the appointment of a receiver but I believed such a course to be the only alternative under the circumstances. "I further expressed a belief that all parties interested and more particularly the depositors, wanted some definite action and I did not propose to stand in the way with technical objections. "That is all a matter of course, however, and under all the conditions I did not feel justified in stultifying myself and my client whom I represented, by joining in this appeal from the court's final decision."
