District Court Hears Case of Florence Bank In addition to various other matters the Fremont county district court has been occupied sinse last Monday morning with the trial of a case growing out of the closing of the Florence State bank some years ago. The proceeding alluded to was brot by George Wilson as receiver of the bank against Mrs. Minnie E. Ruby and son as heirs of Frank Ruby, deceased for the cancellation of certain deeds and transfers of property made to Mrs. Ruby by her husband Frank Ruby, and to subject the property to the payment of a certain judgment ob tained by the bank receiver some years ago, against Mr. Ruby as one of the stockholders of the bank. Mr. Ruby, about the year 1901 became the holder of ten shares of stock of the Florence State bank, at the par value of $100 per share; and the receiver obtained judgment against him on his stock, in double the amount, or a total of $2000. as is provided by the statute concerning the liability of holders of bank stock in such cases. However, after this judgment was obtained. and an execution was issued upon the same, as regards the property or interest of Mr. Ruby, there was no property found on which to collect the judgment. Thereafter and some considerable time ago suit was instituted against Mr. Ruby and Mrs. Ruby for the cancellation of the transfers of property which had passed from Mr. Ruby to Mrs. Ruby and to have the property declared as that of Mr. Ruby (or that of his estate now as he had since died) and to have the same subjected to the payment of his agsessment as such stockholder. Considerable evidence has been submitted to the court and the arguments of council were not completed until noon on Wednesday at which time the court took th matter under advise. ment for decision at a later day. The plaintiff in the case was represented by Messrs. Blunt and Hessick of Florence and Messrs. Jeffrey and Stinemeyer of Canon City: and the defendants were represented by Messre. McLain & Pease. and Judge Ibbotson.
