COURT BUSY DESPITE LACK OF JURY CASES Jury Favors Defendant in Case Against Farm Couple For Rent Since March Though only one jury has been drawn for cases in Burleigh county district court in the last two days, Judge R. G. McFarland has completed considerable work during that perlod. Two cases have been settled out of court, five have been continued until the next term, one appeal from justice court has been dismissed and decisions in two other cases have been made, one by a jury and one by the judge. A jury Thursday forenoon brought in a verdict in favor of the defendant in which the Depositors Holding company sued Mr. and Mrs. W. H. Brown for rent of a farm owned by the company since last March. The jury was out less than an hour before returning a verdict for the defendant. Defense was not represented when the case was presented for the plaintiff by F. E. McCurdy, Bismarck. Foreclosed Last March The company foreclosed on the Brown farm last March, but the Browns continued to occupy the property. Members of the jury were Clarence Kettleson, Wing; Swen Benson, Wilton; Joseph Lewis, Driscoll; F.H. Schroeder, Baldwin; Mrs. Frank Kocher, Jr., Baldwin; Mrs. S. L. Jordahl, Regan; J. W. Riley, city; Walter H. Simons, Baldwin; M. B. Reed, McKenzie; Tebo Harms, Menoken; C. M. Bjerke, Arena; and George Pehl, Jr., Arena. Judge McFarland decided in favor of the plaintiff in the case in which, L. R. Baird, receiver of the Farmers and Merchants State Bank of Driscoll, brought action against K. A. Ersland, J. E. Tierney, and J. M. Lein.
