ALIAS SUMMONS. In the District Court of the Tenth Judicial District of the State of Montana, in and for the County of Fergus. J. Switzer, as the sole surviving director of J. Switzer Co., an expired Montana Corporation, Plaintiff, V8. James M. Eaman, and Nellie F. Eaman, his wife, Fergus County, a corporation of the State of Montana, F. W. Ruzicka, First State Bank of Hilger, a Corporation, F. A. Bell, as Receiver of the First State Bank of Hilger, a Corporation, The Banking Corporation of Montana, Corporation, Claude C. Gray, as Receiver of the Banking Corporation of Montana, a Corporation, Defendants. The State of Montana to the abovenamed defendants, Greeting: You are hereby summoned to answer the complaint in this action which is filed in the office of the clerk of this court, a copy of which is herewith served upon you, and to file your answer and serve a copy thereof upon the plaintiff's attorneys herein within twenty days after the service of this summons, exclusive of the day of service, 'and in case of your failure to appear or answer, judgment will be taken against you by default for the relief demanded in the complaint. That said action is brought to obtain a decree of said court foreclosing of mortgage deed executed by James M. Eaman and Nellie F. Eaman, his wife, to the Banking Corporation of Montana, a corporation, which was assigned to J. Switzer Co., which is at the present time an expired Montana Corporation of which J. Switzer is the sole surviving director, this plaintiff, who is the lawful owner and holder thereof, covering all the lands and premises situate in Fergus County, State of Montana, described as fol lows, to-wit: The Southwest quarter of the Southeast quarter of Section Fourteen (14); the North half of the Northeast quarter of Section Twentythree (23);the North half of the Northwest quarter, the Southwest quarter of the Northwest quarter, and the West half of the Northeast quarter of Section Twenty-four (24), in Township Twenty (20) North, Range Twenty (20) East of the Montana Principal Meridian and containing 320 acres more or less, and given to secure the payment of a promissory note in the sum of Nineteen Hundred Dollars ($1,900.00) principal, together with interest thereon at the rate of twelve per cent per annum from the 1st day of December A. D. 1923; the amount due, being the said principal sum of Nineteen Hundred Dollars ($1900.00) together with interest thereon at the rate of twelve per cent per annum from the 1st day of December, A. D. 1923; also the sum of One Hundred Fourteen Dollars ($114. 00) on interest coupon note number four together with interest thereon at the rate of 12 per cent per annum from the first day of December A. D. 1921 and the sum of One Hundred Fourteen Dollars ($114.00) on interest coupon note number five together with interest thereon at the rate of 12 per cent per annum from the first day of December A. D. 1922 and the sum of One Hundred Fourteen Dollars ($114.00) one interest coupon note number six together with interest thereon at the rate of twelve per cent per annum from the 1st day of December 1923; also the further sum of Eight Dollars ($8.00) cost of continuance of abstract of title together with interest thereon at the rate of ten per cent per annum from the date of the commencement of this suit; also the attorneys fee for plaintiff's attorneys herein, and costs of suit, more particularly described and set forth in plaintiff's said verified complaint on file herein to which reference hereby made for further particulars; that said premises may be sold at sheriff's sale and the proceeds thereof applied to the payment of said indebtedness and costs suit. Pursuant to an order of said court made on the 10th day of July, 1928, notice is hereby given that Monday, the 30th day of July, 1928 at 10:00 A. M., of said day at the court room of said court at the courthouse in the city of Lewistown, County of Fergus, has been appointed as the time and place for proving the will of said Thomas M. Conway, deceased and for hearing the application of Millie L. Kemp and the issuance to her of Letters Testamentary when and where any person interested may appear and contest the same. Meridian, has filed notice of intention to make final proof, to establish claim to the land above described, before Daniel Hanley, U. S.
