LEGAL NOTICES SUMMONS In the District Court of the Nineteenth Judicial District of the State of Montana, in and for the County of Toole. LAKE CITY BANK & TRUST COMPANY Corporation, Plaintiff versus ELBERT HICKS and HICKS, His Wife, Married; SECURITY STATE BANK OF DEVON, Corporation; E. VERNE DAY, RECEIVER OF THE SECURITY STATE BANK OF DEVON, Corporation; CLIFFORD D. COOVER, AS RECEIVER OF THE SECURITY STATE BANK OF DEVON, a Corporation, and as Successor to E. VERNE DAY as Receiver of the SECURITY STATE BANK OF DEVON, a Corporation; and L. DEMPSTER, Defendants. Dempster, in the sum of $1000.00, together with interest at the rate of 10 cent per annum from February 25, 1935; that attached to said promissory note were five coupon notes with the same date for the sum of $60.00 each, due February 25, 1922, 1923, 1984 and 1925, respectively, with interest at the rate of 10 per cent per annum from maturity; together with its reasonable attorney fees and costs and disbursements in said action and to foreclose real estate mortgage dated February 25, 1920, given by said defendant, Elbert Hicks, to secure the payment of said promissory notes and disbursements, said mortgage being filed for record in the office of the County Clerk Recorder of Toole County, State Montana, on February 26, 1920, at o'clock p. and recorded in Book 20 of Mortgages on Page 276, said having been and real estate mortgage been duly assigned to Helen L. Purdy and said promissory notes have been endorsed and real estate mortgage has been duly assigned by her to the Lake City Bank & Trust Company, a Corporation, Plaintiff herein, who is now the lawful holder thereof, all of which will more fully appear from the complaint on file in said action, reference to which is hereby made. And the plaintiff seeks to have said mortgage foreclosed which covers the property hereinafter described and is recorded in Book 24, at Page 154 of Mortgages and Records in the office of the County Clerk and Recorder of Toole County, Montana, and the plaintiff further seeks to bar and foreclose all right and equity of and all claim of every kind of the defendand those claiming under them or any of them. The premises covered by the mortgage and affected by this suit and involved in this action are situated in the County of Toole, State of Montana, and described as follows: S%SW% of Section 26.
