Disregarded Admonition. The jury, however, disregarded this admonition, and within ten minutes after its second retirement appeared with a verdict of not guilty. Herman Congratulated. There was a general scene of congratulation in the court room. Herman expressed thanks to each juror, as he did to his counsel, United States Attorney Baker and many others in the court room congratulated the defendant. Tygard Indicted. Kansas City, Mo., April 27.-The federal grand jury here today returned an indictment against Captain Flavius J. Tygard, charging him with the misapplication of the funds of the Bates County National bank of Butler, Mo., which suspended in September last, and of which he was the president; of the Masonic home of Missouri; the Knights Templar of Missouri; the Walnut Land and Coal company, a corporation with large holdings; the Bates County Investment company, and several estates of which he was trustee. Was Declared Insane. The indictment contains eleven counts, $15,000 being involved. Fol lowing the suspension of the bank, Tygard was declared insane and was confined in a private sanitarium. He is 74 years old.

# MASONS NOT BOUND # FOR TYGARD LOANS. Bates County National Bank Loses Suits for Funds Juggled by Defaulter. # REFEREE MAKES REPORT. The Bates County National Bank, Butler, Mo, cannot recover from the Masonic Home of Missouri, located on Delmar boulevard, and the Missouri Grand Commandery, Knights Templar, as the result of defalcations of F. J. Tygard, according to the report of Referee Robert F. Walker, filed in Judge Rule's court. Tygard was formerly president of the bank, now in the hands of a receiver; treasurer of the Masonic Home and also treasurer of the Grand Commandery, Knights Templar. He was sent to the penitentiary at Leavenworth, Kan., as a result of his defalcations. E C. Vandagrift was appointed receiver of the bank, and later filed one suit against the Masonic Home for $8,394 and another against the Grand Commandery for $22,022 88. He alleged that Tygard, while president of the Bates County National Bank, treasurer of the Masonic Home and treasurer of the Grand Commandery, signed notes as treasurer of the Masonic bodies and passed the money to his credit on the books of the bank.

Bank Cannot Recover From Masons. The Bates County National bank of Butler cannot recover from the Masonic home of Missouri, located in St. Louis, and the Missouri Grand Commandery, Knights Templar, as the result of defalcations of Capt. F. J. Tygard, according to the report of a referee filed in court at St. Louis. Tygard was formerly president of the bank and treasurer of the Masonic home and of the Grand Commandery, Knights Templar. He was sent to the penitentiary at Leavenworth, Kan., as a result of defalcations. E. C. Vandegrift, receiver of the bank, filed one suit against the Masonic home for $8,394 and another against the grand commandery for $22,022.88. He alleged that Tygard signed notes as treasurer of the Masonic bodies and passed the money to his credit in the bank.
