THE STATE OF MONTANA SENDS GREETINGS TO THE ABOVE-NAMED DEFENDANTS YOU ARE HEREBY SUMMONED to answer the complaint in this action which is filed in the office of the Clerk of this Court. copy of which is herewith served upon you, and to file your answer and a copy thereof upon the plaintiff's attorney within twenty days after the service of this Summons exclusive of the day of serice; and in case of your failure to appear or answer judgment will be taken against you by default the relief demanded in the complaint. This action is brought for the purpose of foreclosing and determining the lien of a certain First Mortgage, dated August 22nd, 1928. executed by John J. Pospisil, Josephine Pospisil, his wife, Frank W. Panzenhagen and Meta Panzenhagen, his wife, to The Prudential Insurance Company of America, a corporation. which said mortgage was filed in the office of the County Clerk and Recorder of Fergus County Mon. tana, on the 11th day of September, 1928. at 3:52 o'clock P M. of said day, and duly recorded in Book 102 of Mortgages, at Page 228 thereof, securing the payment of a principal note in the sum of $4200 00 and payment necessary to be made to protect its security; upon which there is now due and owing the sum of $4769.55, together with interest thereon at the rate of ten per cent. costs of suit, costs of abstract and attorney fee: all of which payments and amounts being provided for and protected by said mortgage and to obtain a judgment therefor against the said John Pospisil, Josephine Pospisil, his wife, Frank W. Panzenhagen, and Meta Panzenhagen. wife, as prayed for in Plaintiff's Complaint on file herein, reference to which is hereby made for further particulars; and to obtain an order of sale of the property mortgaged, directed to the Sheriff of Fergus County Montana, and for the purpose of foreclosing equity of redemption of all defendants in the following described property COVered by said mortgage, to-wit: The northwest quarter, the west half the southwest quarter and that part of the east half of the southwest quarter described as follows Beginning at the northwest corner of the northeast quarter of the southwest quarter of Section 8: running thence east 600 feet thence south 900 feet; thence west 200 feet; thence south the south Section line said Section 8; thence west 400 feet; thence north to point of beginning. above described land being in Section 8; and the northwest in quarter of the northwest quarter Section 17. all in Township 15 north, Range 16 east of the Montana Principal Meridian Fergus County Montana Also a strip of land 30 feet in width described as follows Beginning at the southwest corner of the northwest quarter of the northwest quarter Section 17. Township 15 north. Range 16 east of the Montana Meridian running thence south approximately 10 rods: thence to southwest approximatelv 15 rods to the intersection with the Lewistown and Mocassin public road, rods; thence southwest approximate25 rods in length; SAVE AND EXCEPT a railroad right of way to the Great Northern as now established over and across said described land, together with all and singular the tenments, hereditaments and appurtenances, easements, water and all other rights there unto belonging or in any wise appertaining thereto. This action has been instituted for the purpose of recovering the amount due on promissory note for $5,000.00 and incidental obligations and to foreclose real estate mortgage securing the same, all executed and delivered to the plaintiff by the defendant George M. Falls. The plaintiff alleges that there is due and owing to it by said defendant on the obligations involved in this action the balance of 890.00 on the principal note and the principal sum of two unpaid extension interest coupons, together with interest at 8% per annum on $710.00 from January 1931, and $3,180. 00 from January 3, 1932; $70.38 on account of taxes paid with interest at 10% per annum after October 31, 1931; $7.00 for continuation of abstract; reasonable attorney's fees of $200.00; and other costs herem incurred and asks judgment accordingly against the defendants George M. Falls and Hattie Falls and John M Falls, who, It alleged, assumed and agreed to pay the obligations The mortgage involved was filed for record and recorded in Book 90 of Mortgages, page 154, Fergus County records, and the property covered thereinvolved in this action and affectby this suit is situated in Fergus County, Montana, and described as folS½ Section 12. Barrett, husband and wife, to the plaintiff. which mortgage was for the sum of $4800 00 and covers the following described real property, situated in the County of Fergus, State of Montana, to-wit Northwest quarter and the North Half Southwest Quarter Section Seventeen, Township Thirteen North Range Seventeen East of the Montana Principal Meridian, containing 240 acres and which real estate cortgage was filed for record in the office the County Clerk and Recorder of Fergus County on the 27th day of July, 1922. thereafter recorded in Book 94 of Mortgages on page 372. And for the purpose of recovering from the said defendants all sums due and owing, under the terms of said mortgage, as interests and principal thereon, taxes, attorney fees other costs, and for a decree foreclosing said mortgage, and for the sale of the property therein described; all of which more fully appears in the plaintiff's verified complaint on file, reference to which complaint is hereby made. Healy and Lillian Healy. husband and wife, to the plaintiff here in. and the mortgage securing the same with interest, advances, attorney fees and costs, and to foreclose that certain mortgage given to secure said note which mortgage is of record in Book 100 of Mortgages at page 329, records of Fergus County, State of Montant. and which covers the following described real property situated in Fergus State of Montana. to-wit: The southwest quarter of the southwest quarter of Section thirteen; southeast quarter of the southeast quarter of Section fourteen: the north half of the northeast quarter, southeast quarter the northeast quarter, the east half of the southeast and the southwest quarter of the quarter of Section twenty-three; the northwest quarter, the southwest quarter, the southeast quarter, and the south half of the northeast quarter of Section twentyfour: the north half of the northeast quarter, the southeast quarter of the northeast quarter the north half of the Northwest Quarter of Section Twenty-five: the north half of the northeast quarter and the southwest quarter of the northeast quarter of Section twenty-six all in Township thirteen north, Range eighteen least of the Montana Meridian; and lot two of Section thirty, Township thirteen north Range nineteen east of the Montana and for such further relief as prayed for and deemed proper by the Court. all of which more fully appears in the verified complaint filed herein.
