Suit to Forbid Transfer of a Bank. PORT TOWNSEND, Jan 25.-[Special.]-Application was made in the superior court today by William F. Erving, Elizabeth Jones and James W. Jones for the appointment of a receiver to take charge of the Marine Savings bank. The majority of the capital stock, $50,000, in owned by D. T. Denny, of Seattle, J. W. Hinds, F. C. Harper, John W. Scott, Oliver Wood and W. F. Erving. Last Saturday the trustees, Denny, Cashier J. W. Cruthers and H. W. Wheeler, disposed and assigned the entire business to the Commercial bank. Erving, who is one of the trustees, alleges that he nor either of the plaintiffs were consulted with reference to the transfer. He further alleges that he is not allowed to examine the books of the Marine bank or participate in the management of the bank In conclusion the application says: That from the action of said Denny, Cruthers and Wheeler, and from the clandestine transfer of said securities and accounts and from the refusal by the trustees to give the plaintiff Erving or other trustees any account or explanation of said transaction, the plaintiffs allege that the affairs of said bank are being grossly mismanaged, the assets converted and in danger of being lost, and the deposits for which the plaintiffs are liable placed beyond their custody and control, and all the property placed beyond the jurisdiction of the court,
