THE J. N. BROYLES BANKRUPTCY Att'y W. E. Kelley Appointed Referee Creditors Meet June 29 toElect Trustee. J. N. Broyles, the San Marcial banker and merchant, was indicted by the grand jury last week on charges of embezzlementand obtaining money under false pretense. Mr. Broyles has gone into bankruptcy. Attorney W. E. Kelley of this city has been appointed referee and Franz Schmidt will remain temporary receiver until June 29 when all Mr. Broyles' creditors will meet and elect a trustee. Attorney Elfego Baca and Judge Loughary of Albuquerque will represent Mr. Broyles in the legal proceedings which follow. An important feature of the this case developed last Saturday when in behalf of the Bank of Commerce of Albuquerque Attorney H. M. Dougherty brought suit for collection against Mr. Broyles and Chas. M. Crossman, H. Evans, Chas. Lewis, Smith & Storey, Franz Schmidt, C.H. Storey, W. E. Pratt, and E. W. Brown, comakers of notes aggregating $25,000.

VERDICT IN FAVOR OF DEFENDANTS IN PUTNEY CASE Long Drawn Out Legal Battle Over $16,500 Promissory Note Decided Against Plaintiff. I After being out for eighteen hours the jury in the case of R. E. Putney vs. C.H. Schmidt and Charles Story, in which the plaintiff sought to foreclose on a mortgage given as security for a promissory note for $16,500. on which J. N. Broyles, the bankrupt San Marcial banker, appeared as principal and the two defendants as sureties, yesterday morning brought in a verdict in favor of the defendants. The case was one of the lengthiest and most hard fought civil suits tried in Bernalillo county for many years, occupying the attention of the court for more than twelve days. The case was an aftermath of the financial failure of Jasper N. Broyles, for many years the principal merchant at San Marcial. Broyles failed in April, 1908, and his business interests went into the hands of a receiver.
