Bank Receiver Asks Return of Security Given On Large Note
Special to The Tribune.
Lewistown, Dec. 21.βThe Denton State bank, by C. E. Baker, its receiver, has brought suit against H. H. Thompson and his agent here, C. J. Watts, to require Thompson to set out the amount due upon a promissory note of the bank's for $15,000, secured by collateral notes for $35,000, and upon the payment of the sum found by the court to be due, require Thompson to deliver to the plaintiff the collateral notes.
It appears that in March last the Denton bank executed its note for $15,000 to the Pioneer State bank of Tower, N. D., giving the collateral notes as security. The Pioneer bank transferred the notes to Thompson, who, it is alleged, has been collecting on the collateral notes in this state, through his agent, Watts. It is alleged that the plaintiff telephoned to Watts at Great Falls to come over to Denton and receive the money due on the principal note. Watts went there on December 18, but wired Thompson and was informed that the notes were offered at public sale that day at Tower and were bought by Thompson, who declined to make the settlement proposed.
Judge John C. Huntoon has granted a temporary injunction and set the hearing on the case for December 28.
