NOTICE TO CREDITORS OF MONTANA STATE BANK, FALLON MONTANA. Notice is hereby given by the undersigned, as receiver of the Montana State Bank, of Fallon, Montana, a corporation, to the creditors of and all persons having claims against the said corporation, to present such claims, with the necessary vouchers and legal proofs, to the undersigned at his office in the Montana State Bank building, at Fallon, Montana, which is the place selected by the receiver for the transaction of business connected with said corporation, and that all claims must be presented for acceptance to said receiver on or before the first day of July, 1924, and if not so presented within said time such claims will be disallowed. The State of Montana sends greetings to the above named defendants and to each of them: You are hereby summoned to answer the complaint in this action which is filed in the office of the Clerk of this Court, a copy of which is herewith served upon one of you in each County wherein any of you reside, and to file your answer and serve a copy thereof upon the plaintiff's attorney within twenty days after the service of this summons, exclusive of the day of service; and in case of your failure to appear or answer, judgment will be taken against you, by default, for the relief demanded in the complaint, to-wit: For the foreclosure of that certain real estate mortgage given by defendants, William Thorne and Carrie Thorne, his wife, to John F. Sinclair Company, a corporation, and by it assigned to the above named plaintiff, covering the northeast quarter (NE 1/4) of section eighteen (18) township thirteen (13) north, range fifty-three (53) east, Montana Meridian, situated in Prairie County, State of Montana. That said mortgage was filed of record in the office of the County Clerk and Recorder of Prairie County, Montana, on February 9th, 1920, at 9 o'clock a. m. and recorded in Book 6 of Mortgages on page 332. That the sum of One Hundred Twenty Dollars ($120.00) with interest on Sixty Dollars ($60.00) at the rate of ten per cent per annum from November 1st, 1923, together with a reasonable attorney's fee of Seventy-five Dollars, and the costs of this action may be declared to be due and a lien upon said premises. That the usual decree may be had for the sale of said premises by the sheriff of Prairie county, Mont., and that the proceeds of said sales be applied in the payment of the amount found due and that the defendants William Thorne and Carrie Thorne, his wife, and all persons claiming under them, either as purchasers or otherwise, may be forever barred and foreclosed of all right, claim and equity of redemption in and to said mortgaged premises and every part thereof. The Scottish American Mortgage Company, Limited, corporation, Plaintiff. Joseph Merta, Annie T. Merta, Montana State Bank of Fallon, Montana, corporation, Frank Murphy, Mrs. Frank Murphy, Brown. as Receiver of Montana State Bank of Fallon, Montana, corporation, THE STATE OF TO THE ABOVE NAMED DEFENDANTS, GREETING: You are hereby summoned to answer the complaint in this action which filed in the office of the Clerk of this Court, copy of which herewith served upon you, and file your answer and serve copy thereof upon the plaintiff's attorney twenty days after the service this summons, exclusive of the day of service; and case of your failure appear or judgment be taken against you by default for the relief demanded in the complaint. Northeast Quarter of Southwest Quarter of Section Ten. in Township Eleven North of Range Fifty Three, Prairie county, Montana, under mortgage on said land executed by above named defendants to the Scottish American Mortgage curing the said which was recorded in the office of the Clerk and Recorder of Prairie County, Montana in Book of Mortgages, on page 315 thereof.
