ALIAS SUMMONS.
In the District Court of the Sixteenth Judicial District of the State of Montana, in and for the County of Prairie.
G. A. Thiel, plaintiff, vs. William Thorne and Carrie Thorne, his wife, Montana State Bank of Fallon, a corporation, and C. F. Brown, as receiver of Montana State Bank of Fallon, a corporation, defendants.
The State of Montana sends greetings to the above named defendants and to each of them:
You are hereby summoned to answer the complaint in this action which is filed in the office of the Clerk of this Court, a copy of which is herewith served upon one of you in each County wherein any of you reside, and to file your answer and serve a copy thereof upon the plaintiff's attorney within twenty days after the service of this summons, exclusive of the day of service; and in case of your failure to appear or answer, judgment will be taken against you, by default, for the relief demanded in the complaint, to-wit:
For the foreclosure of that certain real estate mortgage given by defendants, William Thorne and Carrie Thorne, his wife, to John F. Sinclair Company, a corporation, and by it assigned to the above named plaintiff, covering the northeast quarter (NE 1/4) of section eighteen (18) township thirteen (13) north, range fifty-three (53) east, Montana Meridian, situated in Prairie County, State of Montana. That said mortgage was filed of record in the office of the County Clerk and Recorder of Prairie County, Montana, on February 9th, 1920, at 9 o'clock a. m. and recorded in Book 6 of Mortgages on page 332.
That the sum of One Hundred Twenty Dollars ($120.00) with interest on Sixty Dollars ($60.00) at the rate of ten per cent per annum from November 1st, 1923, together with a reasonable attorney's fee of Seventy-five Dollars, and the costs of this action may be declared to be due and a lien upon said premises.
That the usual decree may be had for the sale of said premises by the sheriff of Prairie county, Mont., and that the proceeds of said sales be applied in the payment of the amount found due and that the defendants William Thorne and Carrie Thorne, his wife, and all persons claiming under them, either as purchasers or otherwise, may be forever barred and foreclosed of all right, claim and equity of redemption in and to said mortgaged premises and every part thereof.
