ORGANIZATION FORMED BY GROUP IN ATTEMPT TO RELEASE TAX FUND
$10,000 Involved In Action Taken Against West Milton Bank Receiver
An organization, with Theodore Swank as chairman and William Harshbarger as secretary, has been effected by a group of Union township taxpayers to attempt to secure a release of tax funds held by J. E. Maher, receiver of the First National bank, West Milton.
Approximately $10,000 is involved, representing tax payments received by the bank for the December, 1932, payment period and which were not turned over to the county treasurer by the bank before the closing of the institution during the bank holiday in 1933.
The money has been held since by the receiver for the bank on orders of the comptroller of currency at Washington who has held the funds were not trust accounts but classed them as ordinary deposits. Because of the controversy involved none of the tax payments was released when a 42 per cent dividend was paid depositors recently.
Since the county treasurer did not receive the money and as the bank was not acting as an authorized agent for the treasurer the persons whose money is impounded are listed as delinquent in their payments.
Prosecuting Attorney Paul T. Klapp has taken the position the money is a trust fund and should be released but so far the federal officials have refused to agree. Michael E. Norris, attorney for the receiver, is in Washington this week conferring with the comptroller of currency in an effort to secure some settlement of the matter.
Troy, O., May 9—Suit has been filed in the common pleas court by Harry E. Shawen against the First National bank of West Milton and James E. Maher, receiver, asking that the latter be directed to pay the plaintiff and other taxpayers money paid to the defunct bank on taxes on real estate at the December 1932 period. He alleges he paid $130.56 to the bank, that the total amount paid by Union township owners was $12,000 and that this money has been tied up since the closing of the bank, the receiver refusing to refund the money.

Seek To Determine Status of $10,551 In Special Taxpayers' Account —Treasurer Defendant
A new suit, to determine the status of $10,551.94 in a special taxpayers' account in the First National bank of West Milton, now being liquidated, was filed Wednesday in common pleas court by Harry E. and Floyd Shawen, in behalf of 392 taxpayers of West Milton and Union township.
The suit, against Levi Warner, present county treasurer, seeks to determine whether the certificates of deposit issued by the bank at the time of the deposits belong to the county treasurer or the taxpayers.
If the certificates are determined to belong to the taxpayers, the petition asks that a receiver be appointed, to present the claims as preferred claims to the bank's liquidator, and to seek collection from the liquidator of the total amount.
A suit involving the same deposits was filed some time ago and removed to federal court on the petition of the bank liquidator. It, however, was directed against the bank, receiver and county treasurer, while (Continued on Page Two)
FORECLOSURE IS ASKED ON TIPP CITY PROPERTY The Monroe Building & Loan association, through the law firm of Shipman & Shipman, filed a foreclosure suit in common pleas court July 11, against Mary Hannah and L. N. Coffman, Retta Hollingsworth and the county treasurer. The suit involves an unpaid mortgage of $2,644.69 on a property in Tippecanoe City.
CORREY EXECUTOR IS SUED BY MILTON BANK RECEIVER J. E. Maher, receiver of the First National bank at West Milton, filed suit in common pleas court Monday against C. L. Correy, executor of the estate of George B. Correy, for $754.52 said to be due the bank on notes against the estate.
JUDGMENT AGAINST PIQUA COUPLE IS ASKED BY BANK The Piqua Savings Bank company has filed suit in common pleas court for a judgment of $504.07 against T. E. and Ada Coleman of Piqua. The money allegedly is due on an unpaid promissory note, on which a lot in Piqua was given as security.
LOST BOAT IS RECOVERED Sheriff's deputies were called Sunday to the Miami river, near Dugan's bridge, to help M. C. Avery recover his boat, which he had found in possession of a group of boys after it had been missing a week. The boys said they found it floating down the river, and Avery declined to file charges against them.

Two cognovit judgments have been granted in the common pleas court. The first, amounting to $406.50, was granted to J. E. Maher, receiver for the First National bank, West Milton, against Dora Brandon and Angie Agne. The other is to the Laura Lumber Co. against H. S. and Mary E. Cassell and is for $591.53. In both cases the amounts were alleged due on unpaid notes.
