Full Garland Payoff Looms Attorneys Win Reversal of Ruling A 100 per cent payoff to depositors of the defunct. Garland State Bank of Van Dyke loomed as possible today after the state supreme court in a unanimous opinion yesterday set aside a transfer of bank stock by Walter Piper and Hugo J. Hesse and rendered a $9,100 judgment against the pair. Quoting frequently from a brief presented by Hugh H. Neale and John E. Merrill. both prominent Mount Clemens attorneys, the decision reverses the ruling of Circuit Judge Henry Nicol, of Detroit, who held a year ago that the transfer in March of 1932 of stock to the Richmond Realty company was valid. The supreme court ruled that Piper and Hesse, directors of the bank, transferred the stock to escape payment of an expected assessment. The Richmond company was with sufficient assets when the 91 shares of stock once valued at $100 par, were transferred, the court held. Supreme Court Justice Emerson Boyles wrote the opinion which quotes frequently the briefs presented by Neale and Merrill who represented Melvin Van Howe, receiver for the defunct bank.

Garland State Bank Makes Final Payoff Returns Now Total 97.2 Per Cent A 12.7 per cent dividend which brings to 97.2 per cent the return to depositors in the old Garland State Bank, of Van Dyke, was announced today by Melvin Van Howe, receiver. The payoff, which will be the final one of the defunct financial institution, will be participated in by 500 depositors, Van Howe said. He pointed out that certificates must be surrendered at the receiver's office, 25309 Van Dyke avenue, to receive payment. About $15,000 is involved in the final 12.7 per cent return, the receiver said.
