Legal Notice STATE OF MICHIGAN IN THE CIRCUIT COURT FOR THE COUNTY OF WAYNE IN CHANCERY RUDOLPH E. REICHERT, State Banking Commissioner, Plaintiff -vsPEOPLES WAYNE COUNTY BANK OF WYANDOTTE, a Michigan Banking Corporation, Defendant No. 221,877 In Re: Petition of Joseph McGrath, receiver of The Peoples Wayne County Bank of Wyandotte, Michigan, for order approving, ratifying and confirming liquidation of said Bank, disposition of certain uncalled for funds on hand, discharging said receiver and dissolving said Banking Corporation. ORDER TO SHOW CAUSE At a session of the above named Court. held in the Courthouse at the City of Detroit, Michigan, on the 12th day of January, A. D. 1945. Present. Honorable Lila M. Neuenfelt, Circuit Judge On reading and filing the sworn petition of Joseph J. McGrath, Receiver of the Peoples Wayne County Bank of Wyandotte, Michigan, praying that this Court take official jurisdiction of the above entitled matter for the purposes specifically therein prayed, and that in the exercise of its said jurisdiction, and upon due proof of the premises alleged in said petition this Court enter an Order approving, ratifying and confiming the official liquidation of the Peoples Wayne County Bank of Wyandotte, Michigan, by said petitioner and his predecessor receiver, as receiver and successor receiver, of said bank, including the official discharge of said petitioning receiver and decreeing dissolution of the corporate existence of said banking corpoation, and for other and further relief as in said petition prayed, including the final disposition of certain cash funds now in the possession of said petitioner receiver covering and representing certain uncalled for dividends on proven claims, And, it further appearing from said petition that by reason of the multiplicity of the parties in interest in said matter and that many of said parties in interest are non-resident or absent from the State of Michigan, and their whereabouts cannot be ascertained, and because of the diverse changes that have occured in the identity of the parties interested by reason of death, transfers of interest, or otherwise, personal service on all of said parties in interest could not be had without undue prejudice to the equities of the subject matters set forth and alleged in said petition, but that the object and purpose of said petition as expressed in the prayer thereof is common to all parties of direct interest therein as a class, to-wit, common to all of the stockholders and creditors of bank as a class, and that because of inability to make said personal service, and after due consideration of the facts, matters, and circumstances set forth in said petition and in due consideration thereof, IT IS HEREBY ORDERED, That each and every creditor, stockholder and other person interested in the receiver liquidation of the Peoples Wayne County Bank of Wyandotte, Michigan, and in the discharge of said receiver and the dissolutioin of the corporate existence of said Peoples Wayne County Bank of Wyandotte, Michigan, together with the final disposition of certain cash funds now in the possession of said petitioner receiver covering and representing certain uncalled for dividends on proven claims, be and appear before this Court on the 16th day of February, A. D. 1945, at the Circuit Court room in the City of Detroit, State of Michigan, at the opening of Court on said day, or as soon thereafter as counsel can be heard. and THEN AND THERE TO SHOW CAUSE, if any thore be, why the prayer of said petitioner should not be granted and and order entered in said matter, approving, ratifying and confirming the receiver liquidation of the Peoples Wayne County Bank of Wyandotte, Michigan, and discharge of the petitioning receiver thereof. directing final disposition of certain cash funds now in the possession of said petitioner receiver covering certain uncalled for dividends on proven claims. and the final dissolution of the corporate existence of the said Peoples Wayne County Bank of Wyandotte, Michigan, be decreed. pursuant to the provisions of the statutes in such cases made and provided, all according to the prayer of the petition of Joseph J.
