PLAINTIFF WINS APPEAL VERDICT IN HORSE CASE (Continued from Page One) 1,099 cases of eggs to the Miller company with a down payment of $1,100 and the remainder on three notes and open account. He stated that the eggs were held for the Miller for later delivery and that the delivery of them was never called for, that the Marshfield firm finally ordered MacDougall company to sell the eggs and charge their company the difference. He said that efforts had been made to collect the difference. Halgreen testified that no money had been received from Miller since he became manager of the Duluth concern. Directed Verdict The court directed the verdict awarding damages of $4,238.56 to the MacDougall firm after the defense failed to appear for the trial. Artimise Marceau served as foreman of the jury. Upon motion of Hugh W. Goggins, defense attorney the case of H. C. Bring vs. Anderson Motors, Inc. was dismissed when Bring or his attorney failed to appear for trial. Cases announced as settled included G. F. Gear VS. Ralph Tabor and John McCullogh; Marshfield Clinic vs. Town of Lynn; Wadhams Oil company, Milwaukee, vs. Berg Supply company, Marshfield, and Edna G. Reedal vs. W. W. McCullough. Continue Connor Case The case of Robert Connor VS. W. D. Connor, an action to collect $125,000 due in stock in the Connor company, was continued over the term on motion of attorneys. The case of Perry Peters, as receiver of Marshfield bank, vs. Edward Buchmiller, was decided by default. Judge Park issued an order dismissing the case of L. Larson VS. the Seneca, Sigel and Rudolph Mutual Fire Insurance company of Wood county. Cases of Ethel Peck vs. James V. Novak and W. E. Peck vs. James V. Novak were also continued over the term. Trial of the cases of Claus Loonstra VS. Elden Iverson and O. B. Iverson, all persons residing in the Bethel district of the county, started this morning with the selection of a jury. The action is brought to collect damages resulting from an automobile accident. The check of the jury calendar late yesterday revealed that there were 18 cases left, but that five of them, Perry Peters, as bank receiver, against various defendants, would be grouped together. On the calendar of issues of fact for the court, Judge Park allowed continuance of the case of J. C. Stierle and J. F. Stierle VS. Rosa Rohrmeyer, et al, leaving three cases on the court calendar for trial.
