COLUMBIA CITY, Dct. 3.-(I. N.S.)-Thomas D. Barr, chief state banking examiner, through Charles F. Werner here, today filed an application for the appointment of receiver for the Provident Trust company which closed its doors September 18th. The application will be heard before Judge Arthur Biggs of the Whitley Circuit court on October 17th. It stated that after an examination of the books of the bank the examiners found the institution to be in failing and insolvent condition and that the books and sets of the bank now are in the hands of the state banking department. Lloyd S. Crouch, 32, former mayor of this city, and assistant secretary of the bank, whose defalcation now reaching $107,000, was responsible for the receivership action, was still in jail today. He has not yet been arraigned. He has retained an attorney, Ray McAdams, of Ft. Wayne, Ind., but has made no effort to obtain the $19,000 bond fixed by the court.

Claimed Cartoonist Took Maggie Toohey as Common Law Wife.

New York. Feb. 28 Testimony that the late Clare Briggs, newspaper cartoonist, asked her to witness that he took Marie C. Briggs as his wife was offered by Virginia Hammond. negro maid, at the opening yesterday of Mrs. Priggs suit for recognition as the artist's legal widow. The maid testified that in August, 1929 Mr. Briggs took Mrs. Briggs, then known as Maggie Toohey. in his arms and said: Virginia I want you to witness that am taking Maggie here to be my wife." Theodore A. Lesser, Briggs' attorney. testified the cartoonist had asked his advice about marrying Miss Toohey, as he wanted to escape notoriety. Crouch Sentenced.
Columbia City, Ind., Feb. 28 Expressing regret that he could not impose a greater penalty on Lloyd S. Crouch, former mayor of Columbia City. special Judge Rex Emrich, of Kendallville, yesterday sentenced the former bank official to two to fourteen years in Indiana state prison; ansessed a fine of $1,000, and disfranchised the convicted man for six years. Crouch was convicted last week charge of having embezzeld $107,000 of funds belonging to the Provident Trust company, of which he was assistant secretary before It went into receivership.
