First Publication, February 28, 1895,-3w # PUBLICATION NOTICE. In the District Court of Phillips County, Kansas: Mary Fitzgerald, Plaintiff, vs. Henry E. Finch, Elizabeth M. Finch, The Kan- sas Trust and Banking Company of Atchison, Kansas, Freeling Tutts, receiver for the Kan- sas Trust and Banking Company, of Atchison, Kansas, John Rooney, Mary A. Manley, H. Alymer Coates, William H. Risk as executor of the estate of George Manley deceased, de- fendants. Henry E. Finch, Elizabeth M. Finch, John Rooney, Mary A. Manley, H. Alymer Coates, and William H. Risk as executor for the estate of George Manley deceased, will take notice that you have been sued in the above-named court, and that you must answer the petition filed therein by the above-named plaintiff on or before the 15th day of April, 1895, or said petition will be taken as true and a judgment rendered against Henry E, Finch and Elizabeth M. Finch, for the sum of $600, with interest thereon at the rate of 12 per cent per annum, from June 1, 1893, and for costs of suit, and a further judgment against all de- fendants for the foreclosure of a certain mort- gage made by Henry E. Finch and Elizabeth M. Finch to the Kansas Trust and Banking Company bearing Date June 1, 1888, upon the following de- scribed premises situated in the county of Phillips and state of Kansas, to wit: The south half of the northeast quarter of section twenty-eight (28), township three (3), range eighteen (18), and as- signed to this plaintiff before maturity, and ad- judging that the plaintiff has the first lien on said premises to the amount for which judgment will be taken as aforesaid, and ordering said premises sold according to law and the proceeds thereof be applied: Ist. To the payment of the costs of suit; 2d. To the payment of any unpaid taxes which may be a lien on said premises; and 3d: To the payment of the amount found due plaintiff, and forever barring and foreclosing said defend- ants and all persons claiming or to claim under them or either of them of all right, title, interest or equity of redemption in or to said premises or any part thereof.
