ORDER FORBIDS NOTE DISPOSAL IN BANK CASE Injunction Granted to Avon Park Receiver AVON PARK, Sept. (Associated Press.)-Circuit Judge W. J. Barker at Sebring today granted a temporary injunction restraining Charles H. Walker of Bartow from selling, disposing of or manipulating in any way a group of notes payable to the defunct Avon Park State bank totaling $7,498.87. Judge Barker based his order on charges that Walker used certain assets of the bank on the day before it closed in such a manner as "constituted a fraud upon said banking institution, its creditors and depositors." The charges were brought by D. V. Rouse, receiver. He alleged that before the bank closed, Walker presented a check of the Lake Byrd Citrus Packing company, was advised the bank did not have the funds to pay it. and that on the last day the bank was open for business, when "the said C H. Walker well knew that the said Avon Park State bank was utterly insolvent and was well acquainted

The bill alleges Walker then cashed an Avon Park State bank draft for this total amount, which, according to the bill. was "for the purpose of saving from loss and preferring said Lake Byrd Citrus Packing company. The Avon Park bank failed to open the next day. It also alleged in the bill that Walker took up the note from the Citizens bank receiver about Sept. 15, had the remaining collateral, totaling $7498, assigned to him, and that he is negotiating to collect sell the collateral to the "irreparable injury and damage" of the depositors and creditors of the defunct bank.
