# Circuit Court CRUELTY IS CHARGED. Lucy Tracey, colored, was granted absolute divorce from her husband, Everett Tracey in circuit court Saturday morning on grounds of cruel and inhuman treatment. Robert Hill, testifying in the case, drew laughter from the court room when he testified that he was married but did not know whether she was living or dead. # DISMISS KITTERMAN SUIT. The suit of Robert Connell against Claude Kitterman, receiver for the Milton bank, was dismissed at the cost of the plaintiff on motion of that party Saturday. # SUES MILTON BANK. One new claim was filed against the Milton bank, receiver Saturday. It was for $1,600 and was brought by Mary C. Walker. # SUPPORT IS ORDERED. Harry Harvey was ordered to pay Vivian Harvey $7 per week for the support of herself and child by Judge Bond, Saturday. He must pay $50 suit money pending decision in the divorce case. # SUE ON CONTRACT. John W. Brummit, L. Jeffery and Edward Morgan filed suit against Thomas J. Leavell for $3,000 on contract, Saturday. # JONES CASE SET The case of Omer Jones, auto salesman, charged with converting mortgaged goods, will be tried in circuit court before Judge Raymond Springer Jan. 18, it was announced Saturday. # FOLEY DIVORCE SUIT The divorce suit of Fred Foley versus Margaret Foley will be tried Jan. 20. # TURNER WILL SUIT The will case of Charles Turner et al against Mary Berk and others, brought here from Randolph county, will be tried here Feb. 20.

# MILTON BANK CASES # ORDERED ADVANCED Action brought by depositors in the Milton bank was forwarded Tuesday morning when Judge Bond ordered the defendants, Charles Ferguson and others, to answer by Feb. 10 the complaint of the plaintiffs. Eleven cases were involved in the ruling, the plaintiffs and the amounts for which they are suing being as follows: Louis P. Kleiber, 947; Andrew Kerber, $1,616; Sarah Hart, $8,550; Margie Frazee, $6,435; Ed. Trine, $4,188; Charles Kerlin, $2,854; Charles Doddridge, $3,007; Ina Crownover, $2,250; Frank DuGranrut, $1,570; Clemie Market, $1,946; Oliver Wallace, $1,938. Clyde Leverton, defendant in an action for $1,700, brought by Claude Kitterman as receiver for the Milton bank, was ordered by the court Tuesday to answer. The suit of Mrs. H. R. Manlove against Claude Kitterman for $56.34 was dismissed Tuesday at the cost of the plaintiff.

# CLAIMANTS OF MILTON # BANK TO MEET MONDAY A special conference of all parties interested in the Milton bank litiga- tion will be held in the courtroom at 10 o'clock Monday morning, accord- ing to an announcement made by Judge W. A. Bond of the Wayne coun- ty circuit court. Claude S. Kitterman receiver for the bank and attorneys for the claimants and stockholders are to be present. The meeting is to be held for the purpose of settling the matter with as little extra litigation as possible, according to the statement of the court.

# MILTON BANK SUITS' # STATUS UNCHANGED The compromise of the suit of Claude Kitterman against the estate of Lkcurgus Beeson, which was effected at Winchester recently, will have no effect on the balance of the suits filed because of the failure of the Milton bank, according to the statement of a local attorney Friday. The compromised suit was on a bond which Kitterman, receiver for the bank, claimed had been signed by Beeson with Oscar Kirlin, cashier of the bank. The claim was made that this bond had been made out and signed but that it had disappeared. The case was taken to Winchester on a change of venue. Its compromise leaves matters practically unchanged as far as the depositors and stockholders of the bank are concerned. Had it been won by the plaintiff, Kitterman, the Beeson estate would have been liable for the amount of the bond, it was said.

# CASE UNDER ADVISEMENT The suit of Claude Kitterman, receiver for the Milton bank, against Clyde Leverton and the Jackson township bank, came up in circuit court Saturday and was taken under advisement. The Jackson township bank admitted having property to the amount of $1,352, belonging to Leverton, in its possession, and agreed to abide by the decision of the court as to its disposal.

# Short News of City Ice Cream Social—An ice cream social will be held Thursday night at district school No. 11, starting at 7:30 o'clock, which will be open to the public. Ross Lamotte, principal of the school, will have a varied program of activities for the evening. Richmond Community Service will introduce games and will give a moving picture show. Issued Marriage License—Herbert Russel and Thelma Lucille Hazelrigg were issued a marriage license Wednesday. Sprinkler Starts Alarm—A leaky pipe in the basement of the Knollenberg store resulted in the sprinkler system sending in an alarm which turned out the city fire department at noon Wednesday. Husband Tired Waiting — Even though he sent her money on repeated occasions, and asked her to come to this country, Michilene Spatuzzi failed to put in an appearance on this side of the water, according to the complaint for divorce filed by John Spatuzzi in circuit court Wednesday. Sues for Divorce—Cruel and inhuman treatment and failure to support is alleged in the divorce complaint filed by Viola Moore against Edward Moore. Dismiss Bank Suit—Suit of the Milton bank, represented by Claude Kitterman, receiver, against Elmer Little was dismissed after it had been compromised out of court Wednesday. The jury had been drawn and the case was ready to go to trial when the compromise was announced.

# Circuit Court LICENSED TO MARRY Lee S. Hillman, of Richmond, a draftsman and Agnes Harmeling also of Richmond were issued a marriage license Wednesday. SENT TO PENAL FARM Earl Woods, brought into court Thursday on a charge of non support, was sent to the penal farm for a 90-day term, after hearing. Woods was fined $5 and costs and given the sentence Sept. 11. The sentence was suspended at that time, on condition that he support his family. He failed to do so, and the suspension was revoked. SUIT FOR $500 Suit for $500 and interest has been filed by the Prudential Investment company against Harry and Grace Powell. JUDGMENT FOR BANK Judgment for the plaintiff, the First National bank of Connersville, was rendered by the court Thursday against Claude Kitterman, the latter as receiver for the Milton bank, judgment was rendered in favor of Callaway for $1,439. ARRAIGNED IN COURT Frank Fratteleo, 15-year-old youth, was arraigned in juvenile court Thursday on a charge of stealing some parts for a radio set. The parts had been taken by him in order to complete a set, he said. The boy was released on condition that he secure a permit to go to work. He had been arrested twice before, once on a charge of stealing a bicycle and once for cigarette smoking. CASE UNDER ADVISEMENT William Hopkins, Jr., arraigned in circuit court Thursday on a forgery charge, pleaded guilty and his case was taken under advisement by the court.
