Sandusky, Oct. 16—Dismissal of the suit of Harold Avery, receiver for the State bank of Applegate, against John H. Stecker, Vera Stecker Clark, Vearl Stecker Tinsley and Anna Ennest was filed by Circuit Judge X. A. Boomhower Tuesday. The defendants in the case are heirs of Hattie Sherman, deceased, Applegate, stockholder in the State Bank of Applegate. An assessment was levied against the stockholders of the bank, and a claim was filed against the estate of Mrs. Sherman, but not until commissioners on claims had acted on all claims and been duly discharged. The claim against Mrs. Sherman was allowed by the probate judge, and the heirs appealed from the decision, the opinion states.
