11may4tw, Clerk. Order of Publication State of West Virginia: At rules held in the office of the Clerk of the Circuit Court of Harrison County on the First Monday in May, 1906. Oliver P. Boughner against Granville, Knight, admr. of the estate of Jno. C. Wagner, deceased; Bertha Ellen Wagner, Michael Wagner, Lloyd Wagner, Jefferson Wagner, George W. Wagner, Albert D. Mitchell, Harvey W. Mitchell, Dorsey L. Mitchell, Daniel Boughner, Homer D. Boughner and Oliver P. Boughner, late partners trading as Boughner & Sons; Collin A. Lawson receiver of Eureka Loan & Building Association; Martha 0. Goff, M. B. Curkendall; Brown Manufacturing Comapny, a corporation; Meigs J. Bartlett, Armstrong, Crislip, Day & Company, a corporation; The Leatherbury Shoe Company, a corporation; Walthour Candy Company, a corporation; and Clarksburg Bottling Works, a corporation; Upon petition of Peoples Banking and Trust Company, a corporation. The object of the said petition is to set aside a release, executed by Dorsey L. Mitchell the 14th day of May, 1903, of the vendor's lien retained in deed of said Dorsey L. Mitchell to Harvey W. Mitchell the 3rd day of October, 1902, of record in proper office in said county in Deed Book 134, page 93, and to enforce said vendor's lien for the payment of the note recited in said deed as due April 3. 1903, being in the amount of $150.00, and now owned by said Peoples Banking & Trust Company. And it appearing from an affidavit filed in this cause that the said Dorsey L. Mitchell is not a resident of the State of West Virginia, it is ordered that hé appear here within one month after the date of the first publication of this order and do what is necessary to protect his interest in this case.
