Boughner against Granville, Knight, admr. of the estate of Jno. C. Wagner, deceased; Bertha Ellen Wagner, Michael Wagner, Lloyd Wagner, Jefferson Wagner, George W. Wagner, Albert D. Mitchell, Harvey W. Mitchell, Dorsey L. Mitchell, Daniel Boughner, Homer D. Boughner and Oliver P. Boughner, late partners trading as Boughner & Sons; Collin A. And it appearing from an affidavit filed in this cause that the said Dorsey L. Mitchell is not a resident of the State of West Virginia, it is ordered that hé appear here within one month after the date of the first publication of this order and do what is necessary to protect his interest in this case.
