Executrix. Sep22-Oct20 SUMMONS FOR PUBLICATION. In the superior court of the state of Washington for Yakima county: Sol Levinson, plaintiff. vs. Wm. Kincaid and Lucy E. Kincaid, his wife: Jennie French and Lou French. her husband; Bion H. Smith: Wallace-Cobum Hardware Company, a corporation; W. J. Callingham: Ann J. Eaton: Sarah P. Ellis; John S. Miller and G. S. Hough. late partners under the firm name of Miller & Hough: Robert Wingate, as receiver of the Merchant's National Bank of Tacoma; A. J. Query: E. R. Leaming; William B. Dudley; S. S. Foster, as administrator de bonis non of the estate of L. H. Brooks. deceased: Willis Boatman: Fred D. Barto, as receiver of the Bank of Puyallup; and Selah Valley Company, a corporation, defendants. The state of Washington, to the said William Kincaid and Lucy E. Kincaid, his wife; W. J. Callingham: Ann J, Eaton; Sarah P. Ellis; John S. Miller: and E. R. Leaming, defendants. You are hereby summoned to appear within sixty days after the date of the first publication of this summons, to-wit: Within sixty days after the 13th day of October, 1898, and defend the above entitled action in the above entitled court and answer the complaint of the plaintiff, and serve a copy of your answer upon the undersigned attorneys for plaintiff, at their office below stated; and in case of your failure 80 to do, judgment will be rendered against you according to the demand of the complaint, which has been filed with the clerk of said court. The object of said action is to recover judgment against William Kincaid and Lucy E. Kincaid, his wife. for Twelve Hundred and Eighty Dollars ($1280), with interest thereon from July 5th, 1898, at the rate of ten per cent per annum; also for Twenty-five Dollars and Fifty-nine Cents ($25.59), taxes paid on said land. with interest thereon from May 20th. 1896, at the rate of ten per cent per annum; also for Sixty-four Dollars ($64.00) attorney's fee, and for costs and disbursements. claimed by plaintiff upon a promissory note made by William Kincaid and Lucy E. Kincaid, his wife, to the Selah Valley Ditch Company, and assigned to plaintiff, said note bearing date 5th day of January, 1892, for $1280.00, and to foreclose a mortgage executed to secure the payment of said note by said William Kincaid and Lucy E. Kincaid. his wife, upon the following described real estate, situate in the county of Yakima, state of Washington. to-wit: The northwest quarter of the southwest quarter (nw1/4 of sw1/4) of section twenty-nine (29) in township fourteen (14) north of range eighteen (18) east of the Willamette Meridian, containing forty (40) acres, more or less, together with all and singular the privileges, tenements, hereditaments and appurtenances thereunto belonging or in anywise appertaining.
