TUESDAY, MAY 5, 1931 By a four to one vote, following discussion which lasted until after midnight last night, the city council authorized the city attorney to file suit against the receiver of the Tooele County State Bank for the $26,000 of city funds held in the bank at the time of its closing. The claim for the money will be made on the same basis as the school board, who has now amended its complaint to charge that the money was deposited illegally. The city attorney was authorized to spend an extra $500 to secure additional legal help to fight the case. Councilman Shields voted against the suit, while Livers, McKenna, Morgan and Orme stood for the action Supt. P. M Nielsen left this morning for visit to the Wendover and Ibapah schools. He plans to return tomorrow evening. Tooele Central school will hold its annual school exhibit tomorrow and Thursday of this week in the Central school gymnasium. Resume From The Tooele Daily News Friday, June 1931 Following conference this ternoon between H. Street, cal bank receiver, Attorney Draper, and the Tobele County State Bank officials, the information was given that there is no shortage the local bank. The auditor who has been working on the books since the closing the bank, discovered much fauland many accounts had to be re-checked strike balance, and in his final report showed shortage of 000. Following the conference today where the auditor's report was thoroughly checked the bank of. ficials went into their own pockets and made up the shortage. Attorney Draper informed the Daily News, that there was no evi. of dence of criminal shortage, but was their duty to see that the depositors did not stand the loss, due neglectful practices on the part of the bank. During the more than twenty years of business this the first independent audit made of the institution, and it not unusual that shortage of less than year should occur in over credit or long change.
