# FOURTH DISTRICT COURT. Judge King presided in the district court yesterday. John Reese Jones vs. Union Pacific railway; defendant sues to recover $1,000 damages for injuries sustained in a wreck, which occurred on defendant company's road. Jacob Lowe vs. Henry Eddington et. al.; jury returned a verdict of no cause for action. Barlow Ferguson, administrator, vs. Benom Clifford; hearing on demurrer set for March 23. H. Armstrong et. al. vs. Ogden city et. al.; motion of defendants for new trial denied. Robert Furniss et. al. vs. Mary Ann Furniss; ordered that plaintiffs have ten days additional time to prepare and file statement and affidavits on motion for new trial. Catherine Nelson vs. Robert Murdock et. al.; default entered and judgment for plaintiff against defendant for $9,130 and $182.60 attorney's fee. J. S. Beckwith vs. E. M. Slocum; default entered and judgment for plaintiff for $126. Fred J. Kiesel vs. A. Prinfeaux et al.; ordered that defendant's motion for change of venue be denied. Richard Flint vs. T. J. Stayner et. al.; default and judgment for plaintiff in the sum of $597.50. J. C. Armstrong vs. the board of education, of Ogden city. This case was called in the afternoon and occupied the attention of the court during the remainder of the day. It is a very important case and involves many matters connected with the defalcation of City Treasurer Helfrich in 1892. Mr. Armstrong is the receiver of the late Citizen's bank and Helfrich was the bookkeeper at the time. Some twenty-six warrants were issued by the board of education, which were paid by the Citizen's bank as the officials claim by advancing funds when Helfrich had none to his credit. This was done, the bank claims, upon an understanding with the board that funds would be provided. Later. Helfrich settled with the board, turning in these warrants as so much money paid by him, and just then the board discovered that he was a defaulter. Now the bank people want the board to settle the account and the board insists that it has paid the warrants once and will not pay again
