# DEFUNCT OHIO NATIONAL BANK The Central Construction Company Wins a Suit Against It. The case of the Central Construction Company against the Ohio National Bank has been decided against the bank in the District Supreme Court. The attorneys for the bank noted an appeal in the case yesterday, and bond was fixed at $5,000. Argument of the appeal motion will be heard August 16. The decision involves about $3,000. The Ohio National Bank went into voluntary liquidation at the end of the year 1897. A number of the parties interested in the bank then formed the Washington Savings Bank, to take its place. The present suit involves a transaction between the Central Construction Company and the old bank before it went into liquidation. The company borrowed a sum of money from the bank, giving its note for the amount and depositing certain railway securities as collateral. Later the railway went into the hands of a receiver and in the course of time the receiver deposited money with the court for the redemption of all securities, for which receiver's certificates had been issued. The value of the collateral held by the bank was about $25,000, and the construction company notified it to take out the amount of the loan, $16,000, and refund the balance. The bank then sold the securities to itself for the $16,000 instead of turning them over to the receiver and obtaining the full $25,000. It then notified the construction company that there was no balance due it. Such is the contention of the construction company, on which judgment has been rendered.
