# SHERIFF'S SALE. By virtue of an execution, issued out of and under the seal of the circuit court in and for the county of Fall River and state of South Dakota, upon a judgment rendered on the fourth day of December, 1895, and docketed in the said court, on the seventh day of December, A. D., 1895, in an action wherein John L. Burke as receiver of the Minnekahta State Bank, a corporation, is plaintiff, and Fred T. Evans is defendant, in favor of the said plaintiff, and against the said defendant, for the sum of two hundred and fifty-two and 71-100 dollars, debt and damage and fifty-one and 35-100 dollars costs of suit, making a total judgment of three hundred and four and 6-100 ($304.06) dollars which execution was directed and delivered to me as sheriff in and for said county of Fall River I have this sixth day of May, A. D., 1897, levied upon all the right, title and interest of the said defendant, Fred T. Evans, in and to the following described personal property to wit: One certain judgment and decree in favor of Fred T. Evans, sr., for the sum of $47,200.29 rendered on the 28th day of April, 1897, and docketed in said court on the 6th day of May, 1897, in an action in the circuit court of the seventh judicial circuit, South Dakota, in and for Fall River County, wherein Erwin G. Dudley for himself and all others similarly situated are plaintiffs, and William P. Phillips as administrator of the estate of Martha Dudley deceased, intervening plaintiff, and against the Dakota Hot Springs Company, a corporation, Fred T. Evans, sr., Fred T. Evans, jr., Harry D. Clark and Rudolphus D. Jennings as directors of said defendant company, defendants. Notice is hereby given, that I, the undersigned, as sheriff as aforesaid, will sell the above described personal property to the highest bidder, for cash, at public auction, at the front door of the court house in the city of Hot Springs in the county of Fall River and state of South Dakota, on Friday, the 18th day of June, A. Notice is hereby given, that by virtue of an execution to me directed and delivered, and now in my hands, issued out of the clerks office of the Seventh Judicial Circuit Court, State of South Dakota, in and for the County of Fall River, upon a judgment rendered in said court in favor of John L. The Dakota Hot Springs Company, a corporation, Fred T. Evans, Sr., Fred T. Evans, Jr., Harry D. Clark and Rudolphus D. Jennings, as directors of said defendant company, Defendants. By virtue of an execution issued out of and under the seal of the Circuit Court in and for the county of Fall River and the State of South Dakota, upon a judgment rendered therein, on the 28th day of April, A. D. 1897, in the above entitled action which judgment was docketed in said county on the 6th day of May, A. D. 1897, and was for the sum of Forty-Seven Thousand, Two Hundred Doliers and Twenty-nine cents, in favor of Fred T. Evans, Sr, one of said defendants and against the defendant The Dakota Hot Springs Company, a corporation. That said judgment was duly assigned by said Fred T. Evans, Sr. and Theresa M. Evans, to Henry W. Magee, which assignment was duly filed and recorded in the office of Clerk of Courts of Fall River county, South Dakota, on November 26th, 1897, and was thereafter duly assigned by the said Henry W. Magee to Theresa M. Evans, which assignment was duly filed and recorded in the office of Clerk of Courts of said Fall River county, South Dakota, on August 11th, 1899. And the said judgment having been levied upon under an execution in the case of John L. Burke, as receiver of the Minnekahta State Bank vs Fred T. Evans. Sr., and others, and sold by the Sheriff of Fall River county, South Dakota, and a Sheriff's Bill of Sale of said judgment having been given to said Burke, as receiver, the purchaser thereof, and said John L. Burke as receiver as aforesaid having assigned said judgment to Theresa M. Evans, which was duly filed and recorded in the office of Clerk of Courts of said Fall River county, on June 16, 1897; and the said Theresa M. Evans being now owner of said judgment: and whereas said execution was directed and delivered to me as sheriff of Fall River county, South Dakota, I did on the 24th day of January, A. D. 1900, levy upon all of the right, title and interest or the said defendant, The Dakota Hot Springs Company, a corporation, in and to the following described personal property, to-wit: A certain indebtedness of Eight Hundred and Eight Dolars, with interest thereon from November 1899, due and owing from George N. Mimer to the Dakota Hot Springs Company, a corporation, which indebtedness arose from the said George N. Miner causing the Sheriff of Fall River County, South Dakota, to sell and pay over to him, the said George N. Miner, the proceeds thereof, certain real estate under execution in a case wherein the said George N. Miner was plaintiff, and The Dakota Hot Springs Company and others were defendants, the said sum of Eight Hundred and Eight Dollars being the excess of the amount due to the said George N. Miner in the case in which said execation was issued and said real property sold. Now, therefore, notice is hereby niven that I, the undersigned, as sheriff as aforesaid, will sell the above described personal property to the highest bidder, for cash, at public auction, at the front door of the Court House, in the city of Hot Springs, in the county of Fall River and state of South Dakota, on Saturday, the 10th day of February, A. D. 1900, at 2 o'clock, p. m. of that day, and apply the proceeds thereof on said execution on which there s now due the sum of Thirty Thousand, Six Huudred and Seventy-Six and 56-100 Dollars, ($30,676.56) with interest thereon from Dec. 9th, 1899, together with all accruing costs of levy and sale.
