CASE RECORDED Case Of Peruifoy, Ex Parte, Vs. Barnwell Bank Dismissed By Court COLUMBIA. April 4.-The State today handed down an order dismissing petition for rehearing in the case Ex Parte. James E. Peurifoy, receiver for the American Bank & Trust company of Columbia, versus N. B. Gamble receiver for the Home Bank of Barnwell, involving credits between the two banks against losses on deposits by each bank in the other both banks being defunct. The opinion the petition for rehearing by Justice Watts, and other justices concur dissenting Associate Justice Cothran files opinion. The Home Bank had on deposit in the American Trust the sum of $33,000 owed the American Bank & Trust company $20,000 When the American Bank Trust closed owed the Barnwell bank the difference. $13,000. In liquidating the affairs of the Columbia bank Receiver Peurifoy deposited, from salvaged funds, $7,000 in the Barnwell bank Then the Barnwell bank failed and closed. Receiver Peurifoy withheld the sum of $7,000 from payments due the Barnwell bank in dividends from the salvage of the Columbia institution This the bank receiver opposed taking position that he should receive full of dividends due him from the salvage in the American Bank Trust company and the $7,000 should be treated a straight debit due the Columbia receiver. The circuit court held that Receiver Peurifoy course was correct. This the supreme court sustained. and the petition of the Barnwell for rehearing of the case In his dissenting opinion Justice Cothran takes the position that when the American Bank & Trust company failed and went into the hands of a receiver ceased to function corporation. and the deposit of by Receiver Peurifoy could not credited against the obligations of the former banking corporation.
