# REPLY OF # LADD & BUSH In the Matter of the Williams & England Bank. Ladd & Bush have replied to the answer of W. H. Odell, ex-clerk of the school land board in the case of J. A. Baker vs. the Williams & England Banking Company. The reply admits that Mr. Odell, in his capacity as clerk of said board, received many drafts and checks on account of the school fund and that all were drawn to himself personally or as clerk of the board. They deny however, that the checks or drafts were endorsed or deposited with the bank for collection. At the time the bank closed the deposits of Odell amounted to $5047.27 which the bank was unable to pay. To reimburse the land board, Odell borrowed money on his own credit and paid the sum into the state treasury. He then presented his claim for the amount to the receiver of the bank, W. T. Slater. They deny the allegation that the claim was allowed by the receiver, or that the court adjudged that the claim should be paid. At the time the motion of Baker, Metechan, Odell and Giltner was overruled by Judge Boise, it was agreed that the case was still at issue and open for further pleadings. It was set for January 27 at 2 p. m. for further argument to be made.
