ASKS TRANSFER The board of trustees in Chester Township have asked the Common Pleas Court the authority be grant ed them to transfer $325 from the general road fund the general township fund. Fannie M. Myers is the attorney for the plaintiff in the action. MARRIAGE LICENSES A marriage license was issued on Monday to V. J. Adams, 24. of Canaau Township. a farmer, and Wanda N. Belt, 22, of Canaan Township. school teacher. ASK FORECLOSURE Charles A. Jones, receiver of the First National Bank of Frederick town. commenced foreclosure proceedings in the Common Pleas Court against James A. Swank, Roy Swank, Edna Swank, Zachariah D. Swank. Bertha Shawber. Effie M. Greer, the Federal Land Bank of Louisville, the Citizens' Building. Loan & Savings Association, Charles S. Toms. and the Knight Motor Company. The plaintiff asks that each of the defendants other than James A Swank and Roy Swank be compelled to set up their claims in, to or against any of the property located in Chester Township, or be forever barred therefrom. The bank receiver also asks that the court order the property sold and the proceeds be distributed among the several claimants, in accordance to their respective rights and for all other necessary relief. CASES HEARD In the action of the State of Ohio against Ida Gilbert, for the unlawful sale of intoxicating liquor. the defendant in open court had the affidavit read to her, and entered a plea of guilty. The defendant was fined $100 and costs, which were suspended during good behavior. The defendant was ordered to report to the probation of ficer once each month for one year In the action of the State of Ohio against Rosetta Sipe, for unlawful possession liquors, the case was heard and submitted. In the action of the State of Ohio against P. W. Sipe, for the unlawful possession of liquor, the case was heard and submitted. Case was submitted in the action of the State of Ohio against Edith Richie for the unlawful selling of intoxicating liquor decree divorce has been granted to Leo Hunt against Maude Hunt on the grounds of gross neglect of duty. In the partition action of Otis Bennett against Irvin C. Bennett, the action has been ordered, and J. R. Culver, Charles Chandler and Charles Hopkins have been appointed the Sale has been confirmed and the deed ordered and the mortgage has been cancelled in the foreclosure ac tion of the Union Joint Stock Land Bank of Detroit against Albert E. Denton, et al. In the damage action of W. A. Staup against the Patterson Son Company, the plaintiff was in open court and the defendant failed to answer. The jury was by the plaintiff waived, and the case has been submitted to court without a jury, and on the evidence submitted the court finds in favor of the plaintiff of and damages. FILE FOR DAMAGES Three separate damage petitions have been filed in the Common Pleas Court against Harvey O. Yoder, of Cleveland. J. R. Dawson states that on May 10. 1933, he was operating his Ford truck on State Route 41.in Perry Township. On the same date, Dawson's petition states, Harvey O. Yoder was-operating his car at such a high rate of speed that he was unable to bring it to a stop within the assured clear distance ahead. Yoder's automobile ran into the rear of the Dawson truck. Injuries resulting from the accident resulted in $25 for edical services and $125 for damages to the truck Personal damages amounted to the sum of $5,000. Wherefore the plaintiff asks the sum $5,150. The second petition against the Cleveland man was filed by Franklin L. Dawson. by his next friend, J R Dawson. The plaintiff is a minor, and was a passenger in the Dawson truck when the accident occurred. The lad asks for the sum of $5,050, for damages suffered in the wreck. William D. Dawson, by J. Re Daw. son, his next friend, asks for the sum of $5,000 in damages suffered from the accident Benjamin Olds and T. B. Mateer are the attorneys for the plaintiffs in the action. ASK TRANSFER FUNDS The board of county commissioners of Morrow County have filed an application for authority to transfer $8,000 from the undivided automobile tax fund to the general county fund. Fannie M. Myers is the attorney for the plaintiff. the plaintiff asks for the sum of $3,565. The second petition, filed by Frances Welsby, states that as a result of the accident, she was confined to her bed for the period of eight weeks. During the time of her confinement she was unable to earn any money and not now able to do her usual work as saleslady as well as before the accident She states that she ha been damaged to the sum of $15,000. C.H. Wood and Ethel Elder, of Mt. Gilead, and P. L. Horwitz, of Cleveland, are attorneys for the plaintiffs in the two actions.
