DISTRICT COURT PROCEEDINGS Calling of Grand Jury Postponed Upon Showing by District Attorney That It Would Be a Needless Expense The final account and petition for distribution of the estate of Frank Kopp, deceased, was heard by Judge Breen in the District Court on December 10, who ordered that the final account of said administratrix, with the will annexed, be settled, allowed, approved and the estate distributed, and that the said administratrix be discharged. In the District Court on December 15 Judge Peter Breen called the court calendar and the following business was transacted; Louise S. Zadow vs. W. F. ZadowIn the absence of counsel for the respective parties in the above entitled cause, the setting of the case for trial is continued subject to the right of either party to the action to move for a setting of the case for trial upon the filing with the Clerk and serving on the opposite party a notice of 10 days for the same. The two cases of the State of Nevada vs. Wells, Fargo & Co. were continued for the term on motion of counsel for plaintiff. Mary Wren, Executrix et al. vs. Thomas Dixon-In accordance with the stipulation of counsel for the respective parties, counsel for defendant is given 10 days if they see fit to file an amended answer in the above entitled case, the court having been advised of the serious illness of the defendant, Dixon, in the above entitled cause, and the uncertainty of the date of his return to Eureka, the setting of the case for trial will go over for the term. It having been shown to the Court by the statement of the District Attorney, as well as being within the personal knowledge of the Judge of said court, that the calling of a Grand Jury for the present would involve a useless expense and cost to the County of Eureka. it is ordered that the calling of a Grand Jury be continued until the further order of this Court, there being no business of importance for such body to transact at the present time. The Court ordered that the state ment of the District Attorney be spread upon the minutes of the court. The petition of Spencer Reynolds, as Receiver of the Eureka County Bank, asking for an order authorizing the execution of a lease and option upon the Rocco-Homestake mining property at Hamilton, Nevada, to Charles Minoletti, was granted by the District Court in session Friday.

LOCAL BREVITIES. The great Panama-California Exposition at San Francisco opened today. R. A. Laird was a departure down the railroad Tuesday on a business trip. William Gibson of Ruby Hill returned home by yesterday's train from the Rawhide mining district. Mr. and Mrs. James Rogantini were departures by this morning's train for a visit to California and to take in the Exposition. Mrs. Agnes Morrison and her son, James, and daughter, Miss Eileen, autoed in from Antelope Valley Thursday for a few days' visit in Eureka. The Hamilton Mining and Power Company shipped a carload of ore, and the Alkali Mines Company a shipment of high grade ore to the smelters at Salt Lake this week. In another column of to-day's issue the Eureka-Nevada Railway has an official announcement regarding an excursion train to be run over the road from Palisade to Eureka on March 17. Miss Frances Pastorino, who was brought into Eureka Monday suffering from a severe bronchial cold, is now reported to be considerably improved and able to be up and around the house. Sheriff James Mackey went to Cortez this week to serve a writ of execution issued out of the District Court of Washoe County against a mining company near Mill Canyon. The judgment is for a small sum. An order was made last Saturday by District Judge Breen appointing N.P. Morgan as attorney for the Eureka County Bank, whose affairs are now in the hands of the Court for administration. On account of the soft roads and an unusually heavy load of parcel post matter, Tuesday's stage from Palisade arrived here about three hours late and the mail was not ready for delivery that evening untill about 7:30 o'clock. Thursday's stage arrived on time. Henry G. Catlin, who was was interested in mining property in this district in the early days of the camp, was an arrival here from New York City by yesterday's train. It is understood his present visit here is for an inspection of several Prospect Mountain mines. James Romano, his brother, Albino, and sister, Miss Lizzie, left the Romano ranch in Diamond Valley Wednesday for a trip to Elko by auto. The roads were not very bad and they were getting along nicely until the crank shaft on the car broke. This happened in Railroad Valley, about 10 miles north of the Dibble ranch, and as there was no chance to make repairs, the party was forced to walk back to the ranch. After hauling the auto back to the Dibble ranch, the party returned to Diamond Valley by team, and James Romano came into Eureka on yesterday's train.
