TWO CASES DECIDED BY SUPREME COURT The supreme court decided the following cases today: Charles B. Mortill, receiver of the People's Savings Bank and Trust Co, Appellee, vs. M. D. Mastin et al. Appellants. Grant county, No. 2031. This is an action brought by Chas. B. Morrill, receiver of the People's Savings Bank and Trust company of Silver City, N. M., appellee, against M. D. Martin, upon a promissory note executed by appellant in favor of the Capital Savings Investment Co., a foreign corporation authorized to do business in this state, from a judgment entered upon a directed verdict the appellant appeals. Judgment of the court below affirmed. Opinion by Hanna, C. J. Parker and Roberts, J. J., concurring. Eddy County Case George H, Buss, Appelle, VS. The Kemp Lumber Co., etc., No. 2070, Eddy county. This is a suit by George H. Buss, appellee, against John H. Fox, E. F. Hardwick and the Kemp Lumber company, to recover a personal judgment against Fox, obtain a foreclosure of a mortgage executed by Fox and determine the priority of claims between the appellee and Hardwick and the Kemp Lumber company. The Kemp Lumber company has perfected this appeal from a judgment rendered by the trial court in favor of the appellee. Judgment of the court below reversed, with directions to overrule the demurrer to the appellant's answer. Opinion by Parker, justice, Roberts, justice, concurring, Hanna, chief justice, dissenting.
