ORDERS JUDGE RYAN TO NAME READ RECEIVER (By The Association Press.) Santa Fe, Dec. 17.-On petition of the attorney generals office, the supreme court issued today an alternative writ of mandamus returnable December 22. compelling District Judge R. R. Ryan of Grant county to appoint State Bank Examiner J. B. Read receiver 0.0 the Lordsburg State bank, which was closed recently. The court refused to appoint Read on the ground that the law is unconstitutional which requires the bank examiner to be named receiver whenever a bank is closed. Judge Ryan held this to be legislative interference with the judiciary.

Arguments Heard in Action Over Lordsburg Bank Receiver Special to The Herald SANTA FE. Dec. 23. -The supreme court yesterday afternoon heard arguments by attorneys in the action begun by Attorney General Bowman to compel District Judge R. R. Ryan to appoint State Bank Examiner James J. Read receiver of the Lordsburg State bank and took the case under consideration Refusing to appoint Read Judge Ryan held the amendment passed by the 1921 legislature to the banking net unconstitutional on the ground it was an interference of the legislative branch with the judicial Judge Ryan appointed another man receiver and holding his appointment an interlocatory order. refused to grant an appeal to the supreme court. The attorney general's office then applied to the supreme court for a write of mandamus and an order was issued to the district judge to appoint Read or show cause why he should not. It was on this order yesterday afternoon's hearing was held.
