SUES STOCK OWNERS OF MASSILLON BANK

Suits asking double liability assessments from 42 citizens of Massillon who were of the old First National Bank there were filed in Federal Court here. It was the instance of litigation started in court against Massillonites by H. Ross Ake, bank receiver Several ago he sued 24 stockholders of the former Union National Bank in the same manner. The largest amount assessed in today's suits was $9,000. and was against Mrs. France S. Schuckers The total asked in the 42 suits was $64,700.

NAMED BANK RECEIVER

Lima Man to Run Six Ohio Institutions.

WASHINGTON, Sept. 20.—(AP)—Announcement of the appointment of Eugene G. Christen, former Lima banker, as receiver for six northern Ohio banking institutions came today from J. F. T. O'Connor, comptroller of the currency, to the office of Representative Frank L. Kloeb.

Effective Oct. 1, Christen will succeed H. Ross Ake as receiver of the First National Bank and the Union National Bank at Massillon, the First National at Geneva, the First National at Chardon, the Painesville National Bank and the First National at Willoughby.

Reopen Portsmouth Foundry.

PORTSMOUTH, O., Sept. 20.—(AP)—The Foster Stove Co. of Ironton planned today to reopen the foundry department of the Portsmouth Stove & Range Co., one of the largest stove manufacturing plants in the tri-state area.

The plant closed five years ago when it went into receivership. Operations will resume next week.

STOCKHOLDERS FILE APPEAL

Reversal of Decision On Union Bank Double Liability Assessments Sought

CINCINNATI, Nov. 4. (AP)—Four holders of shares in the closed Union National bank of Massillon, appealed to the United States circuit court of appeals today from a lower court decision awarding H. Ross Ake, bank receiver, double-liability assessments against stockholders.

The appeal was filed by F. B. Silk, holding 15 shares; William Limbach, 20 shares; Richard W. Johns, 10 1/2 shares; and William J. Heinauer, 20 shares. They sought reversal of a decision handed down by District Court Judge Samuel H. West in Cleveland, April 15. The bank closed Jan. 3, 1934.
