ENDICOTT DISTRICT JUDGE MOSS DISMISSES SUIT Bank Receiver Dempster Sues to Recover Sum of $15,000 from Stockholders. The case of E. J. Dempster, ceiver for banks in this district, V8. stockholders of the defunct Endicott State Bank, was heard in district court here Monday and dismissed by District Judge Moss on the grounds that the statute of limitations specifies that action must be brought within four years after the assets of a bank have been exhausted. The judge sustained demurrer and the case will be carried to the supreme court. Mr. Dempster brought action on behalf of the guarantee fund commission for the sum of $15,000, the capital stock of the bank. The total liabilities of the Endicott bank at the time of its closing amounted to $41,761.43. The assets were sold January 8, 1923 by R. S. Wilfley, then the receiver, and converted into cash amounting to $21,394.12. Shortly after of the assets, Mr. Dempster through a new law became receiver for the banks in this distritct.
