Cummins & Co., will take notice that on the 27th day of July, 1895, the Davenport Savings bank filed a petition in the district court of said county, against said defendants, and that by order of said court Mary M. Pitcher has been substituted as plaintiff in said cause, the object and prayer of which petition are to foreclose a certain mortgage, executed by Charles D. Pitcher and Cora K. Pitcher, LeGrand M. Baldwin and Aurora M. Baldwin, to the Davenport Savings bank, and by it assigned to Mary M. Pitcher, plaintiff herein, on the following described property: Blocks 18, 19, 20, 21, 25, 26, 28, 14, 40, 41, 42, 43, 45, 39, 46, the S. ½ of 12, 29, 17, except lots 12, 13, except lot 9, 30, except lot 1. 11 and 12-33, except lot 3, 32 except 3, and 9-34 except 3 and 10-27 except 10, 16 except 3, and 12 44 except 4, 5 and 6 24-31 and lot 4, block 15, Pitchers & Baldwin's second addition to University Place, in Lancaster county, Nebraska, to secure the payment of one certain promissory note, dated April 25, 1889, due and payable on the 1st day of May, 1894, for the sum of $10,000. There is now due on said note and mortgage the sum of $2,030. with interest thereon at the rate of 10 per cent per annum from the 1st day of May, 1894, for which sum the plaintiff prays for a decree; that the defendants be required to pay the same, or that said premises be sold to satisfy the amount found due.
