WUPPER BANK LITIGATION Joseph Kellinghaus, a stockholder in the old Beemer State bank whose failute led to a nationwide search for Paul Wupper and eventually to his being sentenced to more than 100 years for bank law violations, carried a suit involving some of the old transactions to the state supreme court. Kellinghaus first began an action in the Cuming county district court after the receiver of the bank refused to classify his claim for 080 along with those of other depositors. The receiver claimed certificates of deposit for the Kellinghaus claim were given by Wupper without consideration. The court held Kellinghaus was entitled to share with other depositors minus offsets of $6,291 for overdrafts but that he should not be paid until his liability as a stockholder was determined. He owned twenty five shares, subject to the state's double liability law. After Wupper was arrested and placed in prison the bank receiver obtained a new trial after claiming that a $46,000 mortgage upon which the Kellinghaus claim had been based, was taken by Wupper personally instead of being assigned to the bank. On the new trial the court held $19,950 from the mortgage had been deposited to the bank's credit by Wupper in the Omaha National bank and that Kellinghaus was entitled to this amount less the $6,291 offset and subject to determination of his stockholders liability. He appealed.
