JUDGE FISK'S DAMAGE SUIT BEFORE COURT laintiff Is Suing Interstate Transportation Company for $5,000 Judge C. J. Fisk's $5,000 damage suit against the Interstate Transportation company is occupying the attention of the Burleigh county district court today, with Judge W. J. Kneeshaw of Pembina on the bench. Judge Fisk. formerly a resident of Minot and at one time a member of the state supreme court. is suing the company for damages for personali injuries which he claims he sustained last March while a passenger of one of the company's busses. The plaintiff claims that at a point about eight miles north of Wilton the bus driver detoured around a snow drift and the bus suddenly dropped into a chuck-hole, throwing the judge against the roof of the bus and causing injuries to his spine. The bus company denies any negligence on the part of its employes. Last Jury Case This will be the last jury case to Be tried before Judge Kneeshaw here. After this is completed. Judge Kneeshaw will hear three court cases, the last of which will be the Patterson tax compromise case, in which a group of citizens have appealed from the action of the Burleigh county board in making a $25,000 reduction from the delinquent taxes of E. G. Patterson. The other two court cases are L. R. Baird as receiver of the Menoken Farmers State bank of Menoken vs. Louis Olson, E. T. Burke, J. P. Spies, J. F. Betz and J. A. Betz, and L. R. Baird as receiver of the First American State bank of Golden Valley vs. David Boeshans, Morris Frank, A. Schlender, G. L. Schlender, H. E. Muelier, Mrs. Hulda Frank and Wm. Langer. The jury late last night returned a vergict in favor of the plaintiff in the case of John J. Levi vs. First State bank of Regan, assessing the damages to which the plaintiff is entitled at $453.79. Judgment For Boepple The case of the Baldwin Piano company vs. Christ Boepple of Cando was tried yesterday afternoon and the jury, within 15 minutes after it had retired, returned a verdict in favor of the defendant. The plaintiff was suing to recover the purchase price of a phonograph. In the case of Richard Lattimore vs. Fred Varney, it was stipulated that judgment be entered in favor of the plaintiff for $75, without costs. No appearance was made by the defendant in the case of the Farmers Bank of Garrison vs. Frank Nichols and in a telephone communication the defendant's counsel conceded that indgme t be entered in favor of the plaintiff. The case of the state vs. Mrs. Nellie Nickelby was dismissed without prejudice, upon motion of the state's attorney and the consent of the de fendant. Affidavits Withdraws Several affidavits of prejudice which had been filed previously against Judge J. A. Coffey of James town were withdrawn today, with the stipulation that the cases be tried at this term of court before Judge Fred Jansonius. Cases thusly in volved are: Clifford. Bowers vs Louis Mauer.
