NOTICE OF CHATTEL MORTGAGE SALE. Notice is hereby given that de fault has been made in the condi tione of that certain Mortgage made by Jens Stenstadvold of the County of Burleigh, and State o North Dakota, Mortgagor to L. R Baird as Receiver of Farmers & Merchants State Bank of Driscoll County of Burleigh and State o North Dakota, Mortgagee, dated the 16th day of October, 1926, to secure the following indebtedness, to-wit One note dated October 16, 1926, fo $2187.50, due October 1, 1927, bear ing interest at the rate of 9% per annum from the date thereof unti paid; and which Mortgage was duly filed in the office of the Register of Deeds of Burleigh County, State of North Dakota, on the 2nd day 0: December, 1926, at 10:20 o'clock a m., and which default is of the following nature, to-wit: that tlie mortgagee has deemed himself in: secure and has elected to and does doclare the whole of said debt due and said mortgagor has failed and refused to pay said debt or any pari thereof; and that there is claimed to be due on said Mortgage at the date of this notice the sum of Two Thousand Two Hundred Ninetythree and 57/100ths Dollars for principal and interest. # NOTICE OF SPECIAL EXECUTION SALE. WHEREAS heretofore judgment and decree in mortgage foreclosure were duly entered on July 25th, 1927, in the office of the Clerk of the District Court for County of Burleigh, North Dakota, wherein Merchants and Manufacturers State Bank, of Minneapolis, Minn., by A. J. Veigel, Com. of Banks of the State of Minnesota, and W. A. Smith, Examiner in charge of liquidation of closed banks for state of Minnesota is plaintiff, and Elmer J. Anderson, Ebba H. Anderson and L. R Baird, as Receiver of Farmers and Merchants State Bank of Driscoll, N. D., are Defendants, and wherein it was adjudged and decreed that Plaintiff recover from Defendants, Elmer J. Anderson and Ebb H. Anderson, the sum of Fifteen Hundred Thirty-eight & 64/100 ($1538.64) DOLLARS, and decreeing that said claim is a valid first mortgage lien upon the real estate therein described, and that said real estate be sold to satisfy the same, and the said lien foreclosed thereby. NOW, THEREFORE, NOTICE IS HEREBY GIVEN that by virtue of a writ of special execution issued out of said Court and directed and delivered to me and now in my hands, and describing said judgment, I. the undersigned, Sheriff, shall offer for sale and sell at public auction to the highest bidder for cash the premises herein described and said sale will be held on the 10th day of September, 1927, at 2 p. m., at the front door of the Court House in the City of Bismarck, North Dakota, to satisfy said judgment and special eexcution. Notice is hereby given that that certain chattel mortgage executed and delivered by Joe Gerts, mortgagor, to L. R. Baird, as Receiver of Farmers and Merchants State Bank, Driscoll, North Dakota, mortgagee, dated the 8th day of November, A. D. 1926, and duly filed in the office of the Register of Deeds of Burleigh County, North Dakota, on the 10th day of November, A. Baird; as Receiver of Farmers & Merchants State Bank of Driscoll, North Dakota, mortgagee, dated the 31st day of August, 1926, and filed for record in the office of the register of deeds of the County of Burleigh in the State of North Dakota, on the 4th day of September, 1926, and duly recorded in Book 184 of Mortgages on page 132, will be foreclosed by sale of the premises in such mortgage and hereinafter described at the front door of the Court House at Bismarck, in the County of Burleigh, and State of North Dakota at the hour of two o'clock p. m., on the 28th day of June, A. D. 1928, to satisfy the amount due upon such mortgage on the day of sale. CIVIL CASES TRIED FIRST AT THIS TERM 24 Jurors Report This Morning-2 More SummonedTentative Schedule Fixed Trial of civil cases was commenced in Burleigh county district court this morning, following the roll call of jurors and the call of the calendar. Criminal cases will not be called until later in the term, reversing the usual order whereby criminal cases are tried first. Only 24 of the panel of 42 jurors were available for duty today, several having been excused and others not having been found by the sheriff. As a result Judge Fred Jansonius ordered another panel of 12 summoned immediately, and these will be drawn sometime today by the sheriff, county treasurer and clerk of court. Jurors who reported for duty this morning include L. H. Richmond, Adrian Asbridge, Joe Brown, A. Thysell, Tony Newgebauer, Dan McDonald, D. J. Warren, Henry A. Jones, P. R. Webb, H. E. Spohn, Tom Cayou and W. G. Worner, Bismarck; K. A. Ersland and W. F. Keeler. Driscoll; E. A. Trygg and Mrs. Jay De Long, Baldwin: Arthur Nelson. Wing; Geo. McMurrich, Brittin; Arnold Peterson, Braddock; Alto Uhde and Eddie Rasche, Regan; H. E. O'Neill, McKenzie; George McIntyre, Arena; Mrs. Bertha Ellison. tSerling. Galliger Arranged Ambrose H. Galliger was arraigned at the opening of today's session on a charge of usury. He was allowed the statutory time in which to enter his plea. Trial of the case of L. R. Baird as receiver of the Farmers & Merchants State bank. Driscoll, vs. M. Syverson was started shortly before noon. The receiver is suing to collect on a note which Syverson had in the Driscoll bank when it closed. The defendant does not deny the note. but claims that he'had a deposit in the bank which would offset the note. Other cases are tentatively scheduled for trial in the following order: L. R. Baird as receiver of Driscoll State bank vs. Chris Junkert. Oscar F. Swenson vs. C. M. Rosson. N. A. Freeburg vs. Interstate Transportation company. Robert Eisenbiesz vs. Henry Plath.

M'FARLAND OPENS MARCH SETS COURT TRIAL SUITS One Case Defaulted, Another Continued, and Third Is Transferred to July Court cases were set this morning for March term of district court when Judge R. G. McFarland returned to hear suits pending on the calendar from the December term. The term was devoted to jury trials and none of the actions for bench decisions were reached then. This afternoon the hearing of trials was started with No. 63, the suit of L. R. Baird as receiver of the Farmers and Merchants state bank of Driscoll against Elick Larson. Zuger and Tillotson represent the plaintiff and Hyland and Foster are appearing for the defence. Other cases set were: 64-L. R. Baird as receiver for the Bismarck bank against .P. E.
