CASCADE BANK CASE CARRIED TO HIGH COURT Notice of Appeal by Anna Brown Placed on File Here Thursday Transcript of an appeal to the state supreme court from the decision of District Judge 11. Ewing in dismissing the stockholders statutory liability action instituted by Anna Brown against B. Roberts and other former stockholders of the Cascade bank Great Falls was filed Thurs day in court, and will be trans mitted to Helena today by the plaintiffs A. H. Gray and Mc Kenzie & McKenzie. The action was instituted by the plaintiff. the complaint. in the behalf of herself and creditors of the bank, which on Febru ary 11. 1920, all its assets to the American Bank & Trust company, now insolvent. At the time the bank suspended op eration, the complaint said, the plain tiff had on deposit in the bank $9,000. no part of which has been paid except $1,086. which tendered her December 1. 1923. by the receiver of the American Bank & Trust company She contends that she at no time released the bank from its liability to her. and that the defendants should be instructed to and required to pay the statutory liability The defense. however, insisted that the American Bank & Trust company assumed all liability of the other in stitution after the merger. and that no responsibility could be attached to the defendants for the failure of the Amer bank December 1921 further asserted that the plaintiff had shown gross and inaction in the of her claim. and the deprived of any possibility of reim bursement from the American Bank & Trust company.
