ORDER TO SHOW CAUSE WHY ORDER OF SALE OF REAL ESTATE, PERSONAL PROPERTY AND OTHER ASSETS SHOULD NOT BE MADE In the District Court of the Eleventh Judicial District of the State of Montana, in and for the County of Lincoln. The State of Montana, Plaintiff, vs. Farmers and Merchants State Bank of Eureka, Montana, a Corporation, Defendant. Oscar F. Wolf, Receiver of Farmers and Merchants State Bank of Eureka, Montana, a corporation, having filed herein his petition, praying for an order of sale of all remaining real estate, personal property and other assets, at either private sale or public auction, and to close the receivership, for the reasons therein set forth. It is Therefore Ordered by the Judge of this Court, that all persons interested in the receivership of said defendant bank appear before the said District Court on the 20th day of May, 1929, at three-thirty p. m. of said day, at the Court Room of this Court, at the Court House, in Libby, County of Lincoln, to" show cause why an order should not be granted to sell all the real estate, personal property and other assets of said defendant, in order that said receivership may be closed. And that a copy of this order be published at least once a week for two successive weeks in the Western News, a newspaper printed and published in said Lincoln County, and posted in at least three public places, for a period of not less than two weeks. Notice is Hereby Given, That in pursuance of an order of the District Court of the Eleventh Judicial District trict of the State of Montana, in for the County of Lincoln, made on the 20th day of May, A. D. 1929, in the above entitled matter, the undersigned, Oscar F. Wolf, the Receiver of Farmers and Merchants State Bank of Eureka, Montana, will, on the 13th day of July, 1929, commencing at ten o'clock A. Closed Eureka Bank Pays 64 Per Cent Oscar F. Wolf arrived from Metaline Falls and on Saturday he held an auction sale to dispose of all remaining properties of the defunct Farmer and Merchant's bank of which he is receiver. After a few separate small bids the entire property was lumped off for $3100. This includes the bank building and fixtures, all real estate, and notes. If the court approves the sale, Mr. Wolf expects to pay the final dividend which will amount to about 14 per cent, soon, probably next month. This bank was closed in October of 1925. This last and final dividend will make a total of 64 per cent which has been paid to the depositors.

Three Plead Not Guilty in Court District court was in session in Libby the latter part of the week, with Judge Charles B. Ellwell of Havre presiding. A divorce was granted Charles D. Eayrs from Ethel E. Eayrs of Rexford The case was not contested. Wm. Herbert was attorney for the plaintiff. Ed. M. Bitterman, James Wade and Helen Hunter were each arraigned on charges of having sold intoxicating liquor to minors. Each of them pleaded not guilty. The final report of the receiver of the Farmers and Merchants State bank of Eureka was submitted and taken under advisement by the eourt. Distribution of the real estate of Lola McRory, deceased, was ordered, the real estate and other assets of the estate going to Mrs. Kittley, mother of the deceased. Court will be held in Libby again on January 13 at 1:30 p. m.
