Commissioners' Proceedings Libby, Montana. April 1st, 1929, The Lincoln county commissioners met in regular session April 1st, 1929. All members present. The Board agreed to furnish Mr. O'Brien and two children county aid. RESOLUTION. Whereas, The Farmers and Merchants State Bank of Eureka, closed in 1915, and, Whereas, there was approximately $27,040.00 of county funds on deposit in said bank when it closed and, Whereas, there is now justly due and owing to Lincoln County, from said closed bank, approximately $3,014.32 and Whereas, The County Attorney has brought suit against F. R. Baney, et al on their bonds for the balance due Lincoln County as aforesaid, and, Whereas, F. R. Baney, et al are desirous of paying the balance due Lincoln County on its said deposits in said Bank, and are ready to do so, providing Lincoln County, through its Treasurer, will assign unto F. R. Baney, et al its Receiver's Receipt from said closed bank and the Receiver's receipt thereof. Now, Therefore, It is ordered that the Treasurer of Lincoln County, upon receipt of said sum of $3,014:32, paid or to be paid by F. R. Baney et al, to assign and set over unto the said F. R. Baney, et al, the above mentioned Receiver's Receipt and all of the rights, claims and interest of Lincoln County to and in said certificate, and the said F. R. Baney, et al, shall' be substituted in lieu and in place of Lincoln County and shall participate to the same extent as Lincoln County would have done if said assignment had not been made. H. E.
