EDWIN S. McKEAN, AND ADDA M. MCKEAN, his wife, FIRST LOAN AND SECURITIES COMPANY, a corporation, and R. L. WELLIVER, as Receiver of FIRST STATE BANK OF BROCKWAY, a corporation,
Defendants.
THE STATE OF MONTANA SENDS GREETINGS TO THE ABOVE NAMED DEFENDANTS:
You are hereby summoned to answer the complaint in this action which is filed in the office of the Clerk of this court, and to file your answer and serve a copy thereof upon the plaintiff's attorney within twenty days after the service of this summons, exclusive of the day of service and in case of your failure to appear or answer, judgment will be taken against you by default, for the relief demanded in the complaint.
The said action is brought for the purpose of obtaining a decree of foreclosure and order of sale upon default for the payment of the following sums, to-wit: For the sum of $120.00 together with interest thereon at 12 per cent from April 10th, 1922; for the sum of $120.00 together with interest thereon at 12 per cent per annum from October 10th, 1923; for the principal sum of $2000.00 together with interest thereon at the rate of 12 per cent per annum from October 10th, 1923; and for attorney fees, and costs of this action and for the payment of the sum of $84.16 paid for 1922 taxes, together with interest thereon at the rate of 12 per cent per annum from February 5th, 1923; and for the sum of $80.90 together with interest thereon at the rate of 12 per cent per annum from November 30th, 1923, paid for 1923 taxes, and for the foreclosure of that certain mortgage made, executed and delivered by Edwin S. McKean and Adda M. McKean, his wife, to First Loan and Securities Company, a corporation, as mortgagee, under date of April 10th, 1918, and which said mortgage was duly filed of record in the office of the Clerk and Recorder of Dawson County, Montana, on April 29th, 1918, and recorded in Book B-52 of mortgage deeds on page 182 thereof, and by transcribed records of McCone County, in Book 10 of mortgages, page 496, and which said mortgage was of record duly assigned to the plaintiff in this action, and said mortgage further affecting the following described real estate, to-wit: The South half (S½) of section eighteen (18) township twenty-one (21) North of Range forty-seven (47) East of the Montana Principal Meridian, Montana, all of which more fully appears in the complaint on file herein and reference to which is hereby made for further particulars.
