Holden, assignee of The Kansas City Safe Deposit and Savings Bank, plaintiff, vs. Thomas H. Gourley. James Pryor. John McGovern, Julia M. Gourley and John H. Gourley, her husband; W. H. Hawkins, John Dolan and Felix Dolan, defendants. Order of Publication. Now at this day comes Howard M. Holden, assignee of The Kansas City Safe Deposit and Savings Bank, plaintiff in the above entitled cause, before the circuit court of Jackson county. Missouri, at Kansas City. and files affidavit stating that the above named defendants, Thomas H. Gourley, John McGovern, John Dolan and Felix Dolan are non-restdents of the state of Missouri, so that the ordinary process of law cannot be served upon them, and praying that an order of publication issue herein. directed to said non-resident defendants. It is therefore ordered by the court aforesaid that publication be made as follows: To Thomas H. Gourley, John McGovern, John Dolan and Felix Dolan, you and each of you are hereby notified that an action has been commenced by Howard M. Holden, assignee of The Kansas City Safe Deposit and Savings Bank, against you and each of you, together with the other defendants hereinbefore named, by petition duly filed in the circuit court of Jackson county, at Kansas City, Missouri, the object and general nature of said petition and suit is to obtain the appointment of a receiver pendente lite for the following described real estate, together with the improvements thereon, towit: Lots twenty-six (26) and twenty-seven (27). block two (2), Fairmount Park, an addition to the City of Kansas, now Kansas City, Jackson county. Missouri, according to the recorded plat thereof. and also to have declared null and void and to cancel upon the records of said county the following instruments and to remove the same as a cloud upon the title to said above described property, to-wit: A power of attorney executed by John McGovern to E. M. Metcalf, recorded in book B 545, at page 373: a power of attorney executed by Julia M. Gourley and husband, John H. Gourley. to W. H. Hawkins, recorded in book B 543. at page 612: a quitclaim deed executed by John McGovern, by E. M. Metcalf, attorney in fact, to Michael J. Dolan, recorded in book B 539. at page 337: a quitclaim deed executed by Julia M. Gourley and husband, John H. Gourley. by W. H. Hawkins, attorney in fact, to Michael J. Dolan, recorded in book B 539. at page 364: a warranty deed executed by Michael J. Dolan to Thomas H. Gourley, recorded in book B 188, at page 246; all of which said instruments and conveyances purport to convey interests and titles to the above described real estate: the further object of said petition is to vest in plaintiff the title of said above described real estate, free and and clear from any and all claims or titles to the same by the defendants hereinbefore named, or either of them, and that unless you appear at the next October term, 1898, of said circuit court to be begun and holden at the state circuit court house in Kansas City. in the said county of Jackson, state of Missouri, on the 10th day of Octo. ber, 1898, and on or before the third day thereof. if the term shall so long continue, and if not, then before the end of the term, and there answer the petition aforesaid, said petition will be taken as confessed and judgment will be rendered against you as therein prayed. It is further ordered that a copy of this order be printed and published in The Kansas City Journal, a newspaper printed and published daily in said Kansas City. Jackson county. Missouri, being the official newspaper duly designated according to law for the publication of legal notices in said Kansas City and the newspaper designated by plaintiff and the court making this order as most likely to give notice to the persons herein to be notified. for four weeks successively, published at least once a week, the last insertion to be at least fifteen days before the commencement of the said October term, 1898. of said court.
